Order of Notice
WHEREAS a civil action has begun against the Heirs of Job Chase by the Plaintiff, 62 Route 28, LLC, seeking to claim title by adverse possession under color of title to the land, buildings and a cemetery located at 62 Main Street, West Harwich, Massachusetts, which was conveyed to the First Baptist Church of West Harwich and Dennisport (also known as First Baptist Church Society - the "Church") by deed from Job Chase dated October 22, 1828 and recorded at the Barnstable Registry of Deeds in Book 2, Page 90 ("Church Property"). The Plaintiff, through a deed from the Church, claims color of title and adverse possession to the Property since 1828.
Since at least the late 1800s, the Church Property has maintained a consistent configuration of approximately 1.5 to 1.6 acres on historic atlases from 1880 and 1905, in historic photographs from 1888, and as shown by abutting deeds and plans. No other deeds into or out of the Church regarding any additional surrounding acreage have been located, and the Church Property's configuration has remained unchanged for over a century.
There are no known living Defendants with any claim of title, and the title as set forth in detail in Plaintiff's Complaint was certified under Mass. Gen. Laws c. 183, § 5B by Plaintiff's Counsel.
In light of the foregoing, we COMMAND YOU if you intend to make any defense, that on July 31, 2026 or within such further time as the law allows you do cause your written pleading to be filed in the office of the Clerk of Court named above, in said Commonwealth, and further that you defend against said suit according to law if you intend any defense, and that you do and receive what the Court shall order and adjudge therein.
Hereof fail not, at your peril, or as otherwise said suit may be adjudged and orders entered in your absence.
It appearing to this Court that no personal service or notice of the Complaint can be made because all potential Defendants are unknown, it is ORDERED that notice of this suit be given by publishing, once a week for three successive weeks, the last publication to be at least 20-days before said return day in the Cape Cod Times.
