NOTICE OF SALE
PLEASE TAKE NOTICE that the above-entitled Court has appointed me Special Master in this matter with the power to sell the following described property together with all easements, appurtenances, abutting streets and alleys, improvements, buildings, fixtures, tenements, hereditaments, equipment, rents, income, profits and royalties, personal goods, mineral, oil, gas, water (whether groundwater, subterranean or otherwise), water rights (whether riparian, appropriated or otherwise, and whether or not appurtenant to the Real Property), wells, well permits, ditches, ditch rights, reservoirs, reservoir rights, reservoir sites, storage rights, dams, and water stock in the County of Doña Ana State of New Mexico (the "Property"). :
A tract of land situate South of Mesilla, Dona Ana County, New Mexico, located in Sections 31 and 32, T.23S., R.2E., N.M.P.M. of the U.S.R.S. Surveys, being U.S.R.S. Tract 13-lA, and being more particularly described as follows, to wit:
BEGINNING at a 1/2" iron rod set on the Northerly line of Carver Road for the Southwest corner of this tract: IDENTICAL to the Southwest corner of U.S.R.S. Tract 13-lA;
THENCE, from the point of beginning, leaving Carver Road. N.30°52'00"W., a distance of 873.88 feet to a 1/2" iron rod set for a corner;
THENCE S.59°08'00"W., a distance of 415.10 feet to a 1/2" iron rod set on the Easterly line of the Park Drain for a corner;
THENCE along the Easterly line of the Park Drain the following three courses and distances: N.31°09'00"W., a distance of 630.92 feet to a 1/2" iron md set for an angle point;
THENCE S.58°51'04"W. a distance of 27.70 feet to a 1/2" iron rod set for an angle point;
THENCE N.29°59'06"W., a distance of 382.21 feet to a 1/2" iron rod set for the Northwest corner of this tract;
THENCE, leaving the Park Drain, N.68°08'20"E., a distance of 620.17 feet to a 1/2" iron rod set for an angle point;
THENCE N.81°19'28"E. a distance of 416.52 feet to a 1/2" iron rod found for the Northeast corner of this tract;
THENCE S.31°l0'30"E., a distance of 798.18 feet to a 1/2" iron rod set for a corner;

THENCE, along the Northerly line of Carver Road, S.60°03'30"W., a distance of 50.01 feet to the point of beginning: SAVING AND EXCEPTING the following 1.264 acre tract: BEGINNING at a 1/2" iron rod found for the Southeast corner of this tract:
WHENCE the Southwest corner of U.S.R.S. Tract 13-lA bears S.09°54'33"E., 1240.76 feet;
THENCE, from the point of beginning, S.63°03'37"W., 452.90 feet to a 1/2" iron rod found for the Southwest corner;
THENCE N.26°39'23"W., 207.55 feet to a 1/2" iron rod found for the Northwest corner;
THENCE N.77°57'43"E., 191.13 feet to a 1/2" iron rod found for an angle point;
THENCE S.86°16'40"E., 310.61 feet to the point of beginning, leaving a net acreage of 20.819 acres, more or less.
Parcel 1:
A tract of land situate South of Mesilla, Dona Ana County, New Mexico, located in Section 31 and 32, T.23S., R.2E., N.M.P.M. of the U.S.R.S. Surveys, being U.S.R.S. Tract 13-3C, and being more particularly described as follows, to wit:
BEGINNING at a 1/2" iron rod found for the Southeast corner of this tract:
WHENCE the Southwest corner of U.S.R.S. Tract 13-lA and the Southwest corner of the above described 20.819 acre tract bears S.09°54'33"E., 1240.76 feet;
THENCE, from the point of beginning, S.63°03'37"W., a distance of 452.90 feet to a 1/2" iron rod found for the Southwest corner of this tract;
THENCE N.26°39'23"W., a distance of 207.55 feet to a 1/2" iron rod found for the Northwest corner of this tract;
THENCE N.77°57'43"E., a distance of 191.13 feet to a 1/2" iron rod found for an angle point;
THENCE S.86°16'40"E., a distance of 310.61 feet to the point of beginning, enclosing 1.264 acres of land, more or less.
Parcel 2:
A non-exclusive easement for road purposes for access to and from the above described Parcel 1, being more fully described as follows:
BEGINNING at a point on the Northerly line of Carver Road, being the Southwest corner of this easement and the Southwest corner of U.S.R.S Tract 13-3A;
THENCE from the point beginning, N.30°52'00"W., 1189.14 feet to the Northwest corner of this easement, and the southerly boundary of Parcel 1 above;
THENCE N.63°03'37"E., 50.12 feet along the southerly boundary of Parcel 1 to the Northeast corner of this easement;
THENCE S.30°52'00"E., 1186.52 feet to a 1/2" iron rod set on the Northerly line of Carver Road, being the Southeast corner of this easement and the Southeast corner of U.S.R.S. Tract 13-3A; THENCE S.60°03'30"W., 50.01 feet, more or less, along the Northerly line of Carver Road to the place of beginning.
The water rights pledged under the Mortgage include, without limitation, OSE File No. LRG-1163. The real estate is located at 792 Carver Rd., Las Cruces, New Mexico.
The Court entered its Summary and Default Judgment and Decree of Foreclosure (hereafter the "Judgment") on May 20, 2026.
The sale is to begin at 9:00 a.m. on July 10, 2026, at the front entrance of the Doña Ana County Courthouse, 201 W. Picacho Ave., Las Cruces, New Mexico 88005. The Property will be sold "AS IS" in one lot to the highest bidder for cash, free and clear of all liens of the parties hereto and all persons claiming under and through the parties or any persons claiming an interest by an instrument filed for record on or after September 25, 2025. Every bid made shall be deemed an irrevocable offer until the sale has been completed, and the sale is completed when confirmed by the Court. In the event the purchaser fails to pay the purchase price at sale, or make satisfactory arrangements with the Special Master for such payment, the Special Master may accept the next highest bid or proceed with the sale of the Property to the highest bidder. The Special Master or his representative may postpone or continue the sale by public declaration at the time and place originally scheduled for such sale. No other notice of the postponed or continued sale need be given.
The purchaser of the Property will take it subject to rights of redemption, any unpaid property taxes, municipal charges, assessments, or liens not identified and foreclosed in this action. The Plaintiff or its assignee has the right to bid at the sale all of the Judgment amount or any portion thereof for credit. TRANSFER OF TITLE SHALL BE WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE PROPERTY AND TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
The proceeds of the sale shall first be applied to pay the expenses of the sale, including special master's fee, then for any costs incurred for the maintenance and protection of the property, then to satisfy the Judgment in favor of Plaintiff.
As of March 27, 2026, the sum necessary to satisfy the Judgment totaled $617,757.97 and is calculated as follows:
Principal: $381,930.62
Accrued Interest: $129,466.79
Late Fees: $5,840.75
Property Preservation Costs and Costs of Collection: $100,519.81
Total: $617,757.97
Interest under the Judgment continues to accrue at the rate of 8.50% per annum ($390.18 per day) after March 27, 2026.
Costs and expenses including, without limitation, reasonable attorneys' fees, disbursements and other property protection advances, and any additional costs of collection and suit incurred after March 27, 2026 (to include the cost of publication of this notice, recording fees, and special master fees) may be awarded by the Court and satisfied from the proceeds of the sale. Any additional proceeds remaining after the satisfaction of the above will be held in trust by the Special Master, paid into the Court Registry by the Special Master, or applied as determined by the Court.
