NOTICE OF ZONING BOARD HEARING
PLEASE TAKE NOTICE that upon the Application of New Jersey American Water Company, Inc. (the "Applicant"), the Zoning Board of Adjustment of the Township of Colts Neck shall conduct a public hearing scheduled on the Secretary's calendar for Thursday, June 18, 2026, commencing at 7:00 P.M., in the Colts Neck Town Hall, 1 Veterans Way, Colts Neck, New Jersey 07722, when it will consider the Applicant's request for Amended (or Preliminary and Final) Site Plan Approval, "d.3" Variance from Conditional Use Standards, Conditional Use Approval and Bulk Variance Approval all related to treatment upgrades at the Applicant's existing Public Utility Water Treatment Plant, known as the Swimming River Water Treatment Plant, located in a Village Residential (A-3) Zoning District, on property that is 320 acres in size, owned by the Applicant, has a street address of 310 Swimming River Road, and is more particularly known as Block 35, Lot 6.01 on the official tax maps of Colts Neck Township (the "Property").
In particular, the Applicant is proposing the installation of water service gradient surge protection improvements related to the protection of the public water supply including, but not limited to, the development of a 696 square foot building that will house the installation of surge tanks for the facility to help regulate pressure in the public water distribution system by absorbing and managing periodic fluctuations in water pressure and maintaining adequate water pressure for customers.
Within the A-3 Zoning District, a Public Utility Facility is conditionally permitted by Ordinance Section 102-11G, and Conditional Use Approval will be requested. In addition, a Variance will be requested pursuant to N.J.A.C. 40:55D-70d.3, from the applicable Conditional Use Standards to allow the Applicant to continue not to provide a fifty (50) foot buffer along the front and southern property lines which is an existing condition in connection with the Swimming River Water Treatment Plant by virtue of a Variance previously granted by the Zoning Board in connection with prior Applications regarding the facility. In addition, Amended Site Plan (or Site Plan) approval is requested for the proposed improvements.
Further, as necessary, Bulk Variance Approval will be requested for the following previously approved existing conditions: (i) spacing of 12 feet between accessory buildings (temporary sodium hypochlorite / storage building to the existing chemical building) when a minimum of 20 feet separation between accessory buildings is required by Ordinance; and (ii) a storage building to be 1,360 square feet in size when a maximum size of 1,200 square feet is permitted for accessory structures.
At the public hearing, you may appear in person, by agent or attorney and present any objection or support which you may have regarding the granting of this Application.
At the public hearing, the Applicant will also reserve the right to amend the Application at the time of the hearing to include any and all other variances, waivers, approvals, or other relief which may be deemed necessary or appropriate by the Zoning Board of Adjustment. The Application, including any plans, documents, reports, and other materials related to it are on file in the Planning/Zoning Department and are available for public inspection during normal business hours at the Town Hall, Lower Floor, 3 Veterans Way, Colts Neck, New Jersey 07722.
