ORDINANCE S-52874 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH VIASUN CORPORATION TO PROVIDE CONSTRUCTION MANAGER AT RISK PRECONSTRUCTION AND CONSTRUCTION SERVICES FOR THE PHOENIX GOODYEAR AIRPORT NEW APRON AND TAXIWAY CONNECTOR PROJECT; TO EXECUTE AMENDMENTS TO THE AGREEMENT AS NECESSARY WITHIN THE COUNCIL-APPROVED EXPENDITURE AUTHORITY; AND FURTHER AUTHORIZING THE CITY CONTROLLER TO DISBURSE FUNDS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX as follows: SECTION 1. The City Manager, or his designee, is authorized to enter into an agreement with Viasun Corporation to provide Construction Manager at Risk Preconstruction and Construction Services for the Phoenix Goodyear Airport New Apron and Taxiway Connector project. The term of the agreement is five years from the issuance of the Notice to Proceed. Work scope identified and incorporated into the agreement prior to the end of the term may be agreed to by the parties, and work may extend past the termination of the agreement. No additional changes may be executed after the end of the term. The value of the agreement will be up to three million dollars ($3,000,000), including all subcontractor and reimbursable costs. Payments may be made up to agreement limits for all rendered agreement services, which may extend past the agreement termination. SECTION 2. The City Manager, or his designee, is authorized to execute all amendments to the agreement as necessary within the Council-approved expenditure authority. SECTION 3. The City Controller is authorized to disburse all funds for purposes of this ordinance. PASSED by the City Council of the City of Phoenix this 20th day of May 2026.
