CITY OF MAXWELL, IOWA SPECIAL MEETING
MAY 27, 2026 IN MAXWELL CITY HALL
These minutes are recorded by the city clerk and are
subject to city council approval at the next regular meeting.
1. The Maxwell City Council held a special meeting on the above date pursuant to the rules of the council, notice posted at city hall, city website, post office, Maxwell State Bank, and Facebook. Meeting called to order by Mayor Pro-Tem Westendorf at 6:00 pm. Roll call was answered by Rothe, Philpott (phone), Westendorf, Miller, and Jans. Guests Shaun Yoder and Clint Sloss (phone).
2. Jans moved; Rothe seconded approval of agenda as presented. All ayes, M/C.
3a. Miller moved; Jans seconded approval of 5/13/26 minutes with two corrections. All ayes, M/C.
4. Rothe moved, Miller seconded, to table discussion and possible action on Third Millennium’s request for release of the $80,000 in grant funds for the Rock Creek Ridge Development until the infrastructure punch list is completed and receives formal approval from the city engineer. All ayes, M/C.
5. Rothe moved; Miller seconded tabling the discussion and possible action regarding Greg Cory’s request to discharge fireworks during his rental of the city park on July 4, 2026 until the 6/10 regular meeting after consulting with the city attorney. All ayes, M/C.
6. Rothe moved; Philpott seconded terminating the 28E Agreement for the Use and Support of a Solid Waste Reclamation, Recycling, and Disposal System Between the City of Ames, Iowa, and the City of Maxwell, Iowa. All ayes, M/C.
7. Rothe moved; Miller seconded tabling the discussion and possible action on the Summer 2027 DOT ADA-Compliant Sidewalk Project until the 6/10 council meeting. All ayes, M/C.
8. Rothe moved; Philpott seconded approval of Res. 2026-33: A Resolution Adopting and Certifying Three Special Assessments for Sidewalk Repair Costs for the Properties Located at 400 Baldwin, 422 Baldwin, and 620 Baldwin. All ayes, M/C.
9. Rothe moved; Westendorf seconded listing broken John Deere mower and accessories through a sealed-bid process with adding the year and removing weed sprayer language and adding “upon receiving the payment” at the end of the posting. All ayes, M/C.
10. Rothe moved; Westendorf seconded purchasing John Deere machine outright with LOSST and General Fund funds equally. RCV: Ayes -Rothe, Westendorf, Miller, Jans. Nays- Philpott. M/C. Philpott lost phone connection.
11. Jans moved; Miller seconded to table discussion and possible action on a potential solar array project and for facilities subcommittee to obtain additional information to bring to the 6/10 meeting. RCV: Ayes -Rothe, Westendorf, Miller, Jans. Absent- Philpott. M/C.
12. Rothe moved; Jans seconded approval of Resolution 2026-34: A Resolution Adjusting the Wage for Part Time Public Works and updating the wording to “back pay for the period of April 29 through current pay period and shall be calculated and issued accordingly.” RCV: Ayes -Rothe, Westendorf, Miller, Jans. Absent- Philpott. M/C.
13. Miller requested discussion of the budgeted FY27 salaries.
14. Philpott moved, Jans seconded adjournment. 7:38pm.
