Request for Upset Bids - Marion Elementary School
Cleveland County Board of Education owns property located at 410 Forest Hill Dr., Shelby, North Carolina, 28150 (Parcel #19754).
On April 17, 2023, the Board voted to declare the above-referenced property surplus. The Board offered the property to the Board of County Commissioners pursuant to N.C. Gen. Stat. § 115C-518(a), and the Board of Commissioners expressed no interest in the property.
The Board finds that the best interests of the Cleveland County Schools would be served by the sale of said real property AS IS in accordance with the North Carolina General Statutes.
On April 13, 2026, the Board voted to accept the highest sealed bid as the initial offer.
The Board also voted to authorize the upset bid procedure to begin on Tuesday, April 14, 2026.
On June 1, an upset bid was made by One More One Less in the amount of $460,948.00.
Currently, the 10 day upset bid period will expire on June 10, 2026.
Qualifying upset bids must increase the previous offer by at least 10% of the first $1,000 and 5% of the remainder . Bidders must submit qualifying upset bids within 10 days after the date of advertisement and be accompanied by a 5% bid bond or deposit. If a qualifying upset bid is received, then a new 10-day advertisement and upset bid process will be repeated until no additional qualifying upset bid is received.
Upset bids must be received by Rob McDaniel, CFO for Cleveland County Schools at Cleveland County Schools Central Services, 400 W. Marion St. Shelby, NC, by close of business on the expiration date.

After the upset bid process is complete, the Board may choose to award the property to the highest bidder or reject all bids.

Example: original bid was $3,000, upset bid must be more than 10% of $1000 plus 5% of $2000 over the original bid = at least $3,200.
