By virtue and in execution of the Power of Sale contained in a certain mortgage given by Gina Fernald and Scott A. Fernald to Mortgage Electronic Registration Systems, Inc,. as mortgagee, as nominee for GN Mortgage, LLC, and now held by Citibank, N.A., not in its individual capacity but solely as Owner Trustee for New Residential Mortgage Loan Trust 2018-3, said mortgage dated April 19, 2004 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 33391, Page 166, as affected by a Loan Modification dated November 6, 2023 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 70016, Page 51; said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as nominee for GN Mortgage, LLC, its successors and assigns to Aurora Bank FSB by assignment dated September 22, 2011 and recorded with said Registry of Deeds in Book 49016, Page 1; said mortgage was assigned from Aurora Bank FSB to Nationstar Mortgage, LLC by assignment dated June 28, 2012 and recorded with said Registry of Deeds in Book 49641, Page 383; said mortgage was assigned from Nationstar Mortgage LLC to The Bank of New York Mellon as trustee for Structured Adjustable Rate Mortgage Loan Trust Mortgage Pass-Through Certificates, Series 2004-6 by assignment dated September 24, 2015 and recorded with said Registry of Deeds in Book 54488, Page 174; said mortgage was assigned from The Bank of New York Mellon F/K/A The Bank of New York, as Successor in Interest to JPMorgan Chase Bank, N.A., as trustee for Structured Adjustable Rate Mortgage Loan Trust Mortgage Pass-Through Certificates, Series 2004-6 to U.S. Bank National Association, not in its individual capacity but solely as trustee for the NRZ Pass-Through Trust VIII-B by assignment dated August 23, 2018 and recorded with said Registry of Deeds in Book 59303, Page 356; said mortgage was assigned from U.S. Bank National Association, not in its individual capacity but solely as trustee for the NRZ Pass-Through Trust VIII-B to Citibank, NA, not in its individual capacity but solely as owner trustee of the New Residential Mortgage Loan Trust 2018-3 by assignment dated February 24, 2020 and recorded with said Registry of Deeds in Book 61999, Page 196; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on July 2, 2026 at 03:00 PM Local Time upon the premises, directly in front of the building in which the unit is located, all and singular the premises described in said mortgage, to wit:
THE FOLLOWING PREMISES, IN THE JOANNA-LYNN CONDOMINIUM SITUATED ON 8 KELLY ROAD, MENDON MASSACHUSETTS, CREATED BY MASTER DEED DATED JUNE 29, 1989 AND RECORDED WITH WORCESTER SOUTH REGISTRY OF DEEDS BOOK 12200, PAGE 305, AS AMENDED, BEING UNIT NO. A, TOGETHER WITH AN UNDIVIDED INTEREST APPERTAINING TO SAID UNIT IN THE COMMON AREAS AND FACILITIES OF SAID CONDOMINIUM, ALL AS SHOWN ON PLANS RECORDED SIMULTANEOUSLY WITH THE SAID MASTER DEED.
THE SAID PREMISES ARE CONVEYED SUBJECT TO AND TOGETHER WITH 'THE BENEFIT OF (A) THE PROVISIONS OF MASSACHUSETTS GENERAL LAWS, CHAPTER 183A AS THE SAME MAY NOW OR HEREAFTER BE AMENDED; (B) EASEMENTS, RESTRICTIONS AND PROVISIONS OF THE MASTER DEED AND AMENDMENTS THERETO, (C) THE PROVISIONS OF THE RECORDED WITH SAID DEEDS BOOK 26643 PAGE 37, ANY AMENDMENTS TO THE SAME AND ANY BY-LAWS AND RULES AND REGULATIONS FROM TIME TO TIME ADOPTED THEREUNDER, AND ALL MATTERS OF RECORD STATED OR REFERRED TO IN SAID MASTER DEED, AS COMPLETELY AS IF EACH WERE FULLY SET FORTH HEREIN.
MEANING AND INTENDING TO DESCRIBE AND CONVEY THE PREMISES CONVEYED BY DEED RECORDED WITH WORCESTER COUNTY REGISTRY OF DEEDS IN BOOK 26643, PAGE 37.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated May 23, 2002 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 26643, Page 376.
Said Unit will be conveyed together with an undivided percentage interest in the Common Elements of said Condominium appurtenant to said Unit and together with all rights, easements, covenants and agreements as contained and referred to in the Declaration of Condominium, as amended.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
