NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Lawrence E. Ruth to Chase Manhattan Mortgage Corporation, dated December 16, 2002 and registered at the Middlesex County (Southern District) Registry District of the Land Court as document number 1244742, and noted on certificate of title number U15318, as modified by a certain modification agreement registered on June 15, 2015, and registered with the Middlesex County (Southern District) Registry District of the Land Court as Document No. 1701440 as noted on Certificate of Title No. U15318, of which mortgage the undersigned is the present holder, by assignment from: JPMorgan Chase Bank, National Association, successor by merger to Chase Home Finance LLC, successor by merger to Chase Manhattan Mortgage Corporation to Goldman Sachs Mortgage Company, registered on October 1, 2020, Document No. 1854887, as noted on Certificate of Title No. U15318
Goldman Sachs Mortgage Company to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2020-GS4, registered on March 25, 2024, Document No. 1953845, as noted on Certificate of Title No. U15318
U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2020-GS4 to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCAF Acquisition Trust, registered on March 3, 2026, Document No. 1995264, as noted on Certificate of Title No. U15318 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 11:00 AM on July 2, 2026, on the mortgaged premises located at 75 Nicholas Road, Unit 75D, Mill Falls Village Condominium, Framingham, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
Condominium Unit 75D of that certain condominium known as Mills Falls Condominium situated at 75 Nicholas Road, Framingham, Middlesex County, Massachusetts created by Master Deed dated October 7, 1982, filed with Middlesex South District Registry of the Land Court on October 19, 1982, as Document No. 629498, as amended by Instrument dated November 23, 1982, filed with said Registry District as Document No. 631525, as further amended by a Second Amendment dated December 1, 1982, filed with said Registry District as Document No. 632626, as further amended by Instrument dated May 9, 1983, filed with said Registry District as Document No. 641625, and as further amended by Instrument dated August 30, 1983, filed with said Registry District as Document No. 646935, together with the 2.230 percent interest in the common areas and facilities of said condominium appertaining to said Unit as provided for in said Master Deed, as amended.
SAID PREMISES ARE SUBJECT TO THE FOLLOWING ENCUMBERANCES:
1. The provisions of Massachusetts General Laws, Chapter 183A; easements, restrictions, covenants, reservations, terms and conditions contained or referred to in said Master Deed, as amended as aforesaid, and the Declaration of Trust of Mill Falls Village Condominium Trust, dated October 7, 1982, filed with said Registry District as Document No. 638255 or Site Plans and Floor Plans as duly recorded in the appropriate land records office and as the same may have been lawfully amended.
2. Utility Easement, dated March 5, 1956, filed as Document No. 304070 with said Registry District with Certificate of Title No. 159216, Registration Book 929, Page 66.
3. Utility Easement, dated August 5, 1957, filed as Document No. 322697 with said Certificate of Title given to Boston Edison Company and New England Telephone and Telegraph Company.
4. Order of Taking for the laying our of Nicholas Road as public street by the Town of Framingham, filed as Document No. 322752, dated September 17, 1957.
5. Order of Taking for the laying out of Nicholas Road as a public street by the Town of Framingham, filed as Document No. 353700, dated April 12, 1960.
6. Utility Easement shown on plan filed as Land Court Plan No. 3857-48 with Certificate of Title No. 90886, Registration Book 583, Page 136.
7. Restrictions relating to the use of the land to run with the land for a period of fifty (50) years from the date of the Document No. 395368 namely August 1, 1963.
8. Utility Easement and Drain Easement shown on a plan filed in Registration Book 584, Page 136, set forth in Document No. 315165.
9. Utility Easement, set forth in Document No. 420066, and referred in Document No. 422039.
10. Grant of Easement to Pinewood Builders, Inc., dated May 24, 1956, filed with said Registry District as Document No. 306187.
11. Agreement between Donald E. Carlson, et al, Trustees, and David Dickerman, et al, Trustees, dated June 21, 1965, filed with said Registry District as Document No. 422038, as assigned to Robert Waldman, et al, dated August 3, 1966, filed with said Registry District as Document No. 435370.
For mortgagor's(s') title see deed registered with Middlesex County (Southern District) Registry District of the Land Court as Document No. 1244741, as noted on Certificate of Title No. U15318.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
