AN ORDINANCE OF
THE TOWN OF SECAUCUS, NEW JERSEY
ORDINANCE NO. 2026-26
AN ORDINANCE REPEALING CHAPTER 96 OF THE CODE OF
THE TOWN OF SECAUCUS ENTITLED “PARENTAL RESPONSIBILITY”
WHEREAS, the Town of Secaucus previously adopted Chapter 96 of the Code of the Town of Secaucus on October 9, 1996, to address the responsibility of parents to supervise their minor children to preserve the public peace, health, safety and welfare of the public; and
WHEREAS, the State of New Jersey enacted to P.L. 1967, c.271 (N.J.S.A. 2C:43-8 et seq.), which defines “truancy” as a situation where a child between the ages of six and 16 is repeatedly absent from school and where the child’s parent or guardian is unable to cause him to attend school; and
WHEREAS, under N.J.S.A. 2C:43-8 et seq., parents/guardians may be charged with a disorderly persons offense if their child does not attend school; and
WHEREAS, the Town of Secaucus, upon review of the above and the advice of Town Counsel, is repealing its Ordinance to reflect the State’s regulations and guidance.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Town of Secaucus, County of Hudson, State of New Jersey, as follows:
1. Chapter 96 of the Code of the Town of Secaucus entitled “Parental Responsibility,” originally adopted on October 9, 1996, under Ordinance Number 1996-29, be repealed in its entirety.
2. All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.
3. If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to that section, subdivision, clause or provision so adjudged and the remainder of this Ordinance shall be deemed to be valid and effective.
4. This Ordinance shall be published in accordance with law and shall take effect upon such.
NOTICE
Notice is hereby given that the foregoing proposed ordinance was introduced and passed on first reading at a meeting of the Mayor and Council of the Town of Secaucus in the County of Hudson, New Jersey, on the 27th day of May, 2026 and that said ordinance will be taken up for further consideration for final passage at a meeting of said Mayor and Council to be held in the Municipal Government Center, 1203 Paterson Plank Road, Secaucus, New Jersey, on the 23rd day of June, 2026, at
7:00 p.m., or as soon thereafter as said matter can be reached, at which time and place all persons who may be interested therein will be given the opportunity to be heard concerning the same.
A copy of this ordinance has been posted on the bulletin board upon which public notices are customarily posted in the Secaucus Municipal Government Center and a copy is available up to and including the time of such meeting to the public of the town, who shall request such copies, at the office of the Town Clerk in said Municipal Government Center in Secaucus, New Jersey.
