NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Cody Conway to Mortgage Electronic Registration Systems, Inc., as nominee for Fairway Independent Mortgage Corporation, dated March 13, 2024 and registered at the Barnstable County Registry District of the Land Court as document number 1498505, and noted on certificate of title number C33-1WC, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Fairway Independent Mortgage Corporation, its successors and assigns to Lakeview Loan Servicing, LLC, registered on January 8, 2025, Document No. 1516055, as noted on Certificate of Title No. C33-1WC
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 3:00 PM on July 7, 2026, on the mortgaged premises located at 800 Bearse's Way, Unit No. 1WC, Cape Crossroads Condominium, Hyannis (Barnstable), Barnstable County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
That certain condominium unit in the Cape Crossroads Condominium, situated in Barnstable (Hyannis), Barnstable County, Massachusetts, designated as follows:
Unit No. 1WC as described in Master Condominium Certificate of Title No. C33 in the Master Deed, Document No. 204,841, as amended by Documents No. 216,084 and No. 225,601, and indicated on Condominium Plan No. 30582-E-1 together with an undivided fractional interest in the common areas as set forth in the Master Condominium Certificate and Master Deed and as they may be or have been lawfully amended under the provision of said Chapter 183A.
Subject to and with the benefit of all easements as set forth in said Master Condominium Certificate and Master Deed and amendments thereto.
And it is further certified that the land described in said Master Condominium Certificate is under the operation and provisions of Chapter 185 of the General Laws, and any amendments thereto, and that the interest of the grantee to said unit is set forth under Section 3 of said Chapter 183A. Subject, however to any of the encumbrances mentioned in Section forty-six of said Chapter 185 of the General Laws and any amendments thereto which may be subsisting and subject also to any unregistered variances from the applicable unit plans and to the existence at any time of the building contained the unit.

For mortgagor's(s') title see deed registered with Barnstable County Registry District of the Land Court as Document No. 1498504, as noted on Certificate of Title No. C33-1WC.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
