By virtue of and in execution of the Power of Sale contained in a certain mortgage given by David M. Portela to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Countrywide Home Loans, Inc., its successors and assigns, dated January 14, 2005 and recorded in Bristol County (Southern District) Registry of Deeds in Book 7372, Page 62 (the “Mortgage”), as affected by a Loan Modification Agreement dated June 1, 2006, and recorded at said Registry of Deeds in Book 8240, Page 267, and further affected by a Loan Modification Agreement dated September 15, 2017, and recorded at said Registry of Deeds in Book 12297, Page 134, and further affected by a Loan Modification Agreement dated January 10, 2018, and recorded at said Registry of Deeds in Book 12381, Page 161, and further affected by a Loan Modification Agreement dated July 21, 2022, and recorded at said Registry of Deeds in Book 14473, Page 285 of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., its successors and assigns to Countrywide Home Loans, Inc. dated April 10, 2006 and recorded at said Registry of Deeds in Book 8515, Page 253, and Assignment from Countrywide Home Loans, Inc. to BAC Home Loans Servicing, LP dated July 30, 2010 and recorded at said Registry of Deeds in Book 9785, Page 135, and Assignment from Mortgage Electronic Registration Systems, Inc., its successor and/or assigns to Bank of America, N.A., successor by merger to BAC Home Loan Servicing, LP FKA Countrywide Home Loans Servicing, LP dated July 19, 2012 and recorded at said Registry of Deeds in Book 10468, Page 77, and Assignment from Bank of America, N.A. to Green Tree Servicing LLC dated April 9, 2013 and recorded at said Registry of Deeds in Book 10892, Page 199, and Assignment from Bank of America, N.A. successor by merger to BAC Home Loans Servicing, LP to Mortgage Electronic Registration Systems, Inc., as mortgagee, its successor and/or assign dated May 4, 2020 and recorded at said Registry of Deeds in Book 13214, Page 346, and Assignment from Ditech Financial LLC f/k/a Green Tree Servicing LLC to New Residential Mortgage LLC dated May 4, 2020 and recorded at said Registry of Deeds in Book 13214, Page 347, and Assignment from New Residential Mortgage LLC to NewRez LLC, d/b/a Shellpoint Mortgage Servicing dated August 12, 2020 and recorded at said Registry of Deeds in Book 13368, Page 273, and Assignment from New Residential Mortgage LLC to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust dated March 7, 2022 and recorded at said Registry of Deeds in Book 14265, Page 298, and Assignment from NewRez LLC, d/b/a Shellpoint Mortgage Servicing to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust dated April 13, 2022 and recorded at said Registry of Deeds in Book 14312, Page 193, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 567 Old Bedford Road, Westport, MA 02790 will be sold at a Public Auction at 10:00 AM on July 1, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

The land in Westport, Bristol County, Massachusetts located on the southerly side of Old Bedford Road and being designated as "A" and "B" on Plan of Land in Westport, Massachusetts for Man Car, Inc., Scale: 1"= 60' dated May 19, 1984, Allen D. Quintin, R.L.S., 28 Costa Street, No. Dartmouth, Mass., and recorded in the Bristol County Southern District Registry of Deeds on November 29, 1984 in Plan Book 1100, Page 152.
Parcel II:
That triangular parcel of land situated on the southeasterly side of Old Bedford Road, in Westport, MA being shown as Parcel "A" on that plan entitled "Plan of Land in Westport, Mass. Owned by Arthur D. & Cheryl E. Ferreira, Scale 1"- 60', July 23, 1996", Allen D. Quintin, P.L.S. 28 Costa Street, N. Dartmouth, MA containing 2,792 square feet, which plan is recorded with Bristol County (S.D.) Registry of Deeds, Plan Book 135, Page 100.
For mortgagor’s title see deed recorded with the Bristol County (Southern District) Registry of Deeds in Book 7372, Page 61.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
