vs.
ANNIECE EILEEN ACKER, CO-TRUSTEE ACA TRUST I, DATED MARCH 1, 2009 & CHRISTOPHER DAVID ACKER, CO-TRUSTEE ACA TRUST I, DATED MARCH 1, 2009, et.al., Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 31st day of March, 2026, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 25th day of February, 2026, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, as follows:
The principal sum of $5,240.42, together with interest thereon at the rate of 7.75% per annum from the date of this Judgment until paid; Plaintiff’s costs of Court in the amount of $1,165.64, and reasonable attorney’s fees in the amount of $2,605.00, according to Article 6, Section 6.02 of the CC&Rs, plus interest on all costs and fees at the maximum per annum rate allowable by law at 7.75% per annum from the date of judgment or accrual after judgment, until paid; That Plaintiff obtained a personal judgment against Defendants Anniece Eileen Acker, Co-Trustee ACA Trust I, dated March 1, 2009 & Christopher David Acker, Co-Trustee ACA Trust I, dated March 1, 2009 in the San Marcos Justice Court, Case No. CC2024262141RC (the “Personal Judgment”), and that attorneys’ fees in the amount of $1,532.50 and costs of court in the amount of $366.65 awarded therein are secured by the assessment lien pursuant to A.R.S. §33-1807 and may be collected through foreclosure of the assessment lien; That Plaintiff has an assessment lien in the amount of $7,139.57, and that such amount may be collected through a sheriff’s sale of the Property, including Annual assessments, late fees, and collection charges that shall accrue from the date of this judgment until the time of sale, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 323, PARCEL D-6 AT TROON NORTH, according to Book 404 of Maps, Page 34, and Affidavit recorded in Document No. 96-0073808, records of Maricopa County, Arizona. EXCEPT all the coal and other minerals reserved in the Patent.
AKA: 9865 E Quarry Trl, Scottsdale, Arizona.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 2nd day of July, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
