By virtue and in execution of the Power of Sale contained in a certain mortgage given by James M McCarthy to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Pacific Union Financial, LLC, and now held by NewRez LLC d/b/a Shellpoint Mortgage Servicing, said mortgage dated April 7, 2015 and recorded in the Plymouth County Registry of Deeds in Book 45415, Page 1, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as nominee for Pacific Union Financial, LLC to Ditech Financial, LLC by assignment dated January 28, 2019 and recorded with said Registry of Deeds in Book 50760, Page 110; said mortgage was assigned from Ditech Financial LLC to New Residential Mortgage LLC by assignment dated March 16, 2020 and recorded with said Registry of Deeds in Book 52482, Page 111; said mortgage was assigned from New Residential Mortgage, LLC to NewRez LLC d/b/a Shellpoint Mortgage Servicing by assignment dated June 19, 2020 and recorded with said Registry of Deeds in Book 52939, Page 193; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on July 9, 2026 at 09:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:

PARCEL ONE
The land with the buildings thereon situate in said Pembroke, and bounded and described as follows:
Beginning at a stake at the Northeasterly corner of the granted premises on the shore of Little Sandy Pond; thence running South 10 deg.50' West, fifty -five and 5/10 (55.5) feet to an iron bar at the Southeasterly corner of the lot on the Northerly side of School Street; thence turning and running by said School Street North 73 deg West, twenty-four and 5/10 (25.5) feet to a stake at the Southwesterly corner of the lot; thence turning and running North 7 deg. 22' East, forty-six and 5/10 (46.5) feet to a stake in the wall on the shore of Little Sandy Pond; thence turning and running Easterly twenty seven and 8/10 (27.8) feet to the point of beginning.

A certain land parcel of shown as Lot 25 on Assessor's Plan Book B-4, as described in Treasurer's Deed to Charles S Beninato and Angela Beninato, dated November 22, 1965, and recorded in Book 3256, Page 489, Plymouth County Registry of Deeds.
For title reference see deed recorded herewith.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated April 6, 2015 and recorded in the Plymouth County Registry of Deeds in Book 45414, Page 336.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
