NOTICE OF FORECLOSURE SALE UNDER POWER
JEFFERSON COUNTY, GEORGIA
Under and by virtue of the Power of Sale contained in a Security Deed given by Jimmy James Wells and Ruthie Mae Wells to Argent Mortgage Company, LLC, dated September 15, 2004, and recorded in Deed Book 373, Page 551, Jefferson County, Georgia Records, as last transferred to Deutsche Bank National Trust Company, as Trustee for Argent Securities Inc., Asset-Backed Pass-Through Certificates, Series 2004-W11 by assignment recorded on February 19, 2009 in Book 453 Page 448 in the Office of the Clerk of Superior Court of Jefferson County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Sixty-Seven Thousand Two Hundred and 0/100 dollars ($67,200.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Jefferson County, Georgia, within the legal hours of sale on July 7, 2026, the following described property:
All that lot or parcel of land, with improvements thereon, situate, lying and being in the 81st District G.M. of Jefferson County, Georgia, containing .649 acre, more or less, being slightly irregular in shape and bounded as follows: on the North by the right of way of a 50 foot street, on the East by the right of way of a 50 foot street, on the south by the right of way of State Route No. 80 and on the West by property of Clarence Vaughner and being more particularly described and delineated on a plat of survey by Edward G. Andrews, R.L.S. made on April 24, 1974. Reference is drawn to said plat for a more particular description of said
lot of land as to metes, bounds, courses, and distances.
This is the same property conveyed by Warranty Deed dated July 3, 1986 from Richard E. Yancey to Jimmy James Wells and Ruthie Mae Wells and recorded in the Office of the Clerk of Superior Court of Jefferson County, Georgia, in Deed Book 158, at page 611.
Said property is conveyed subject to any and all easements and restrictions of record.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: Onity Mortgage Corporation F/K/A PHH Mortgage Corporation they can be contacted at 1-800-750-2518 for Loss Mitigation Dept, or by writing to 1661 Worthington Rd., Ste. 100, West Palm Beach, Florida 33409, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Jimmy James Wells and Ruthie Mae Wells or tenant(s); and said property is more commonly known as 2232 Ga Hwy 102, Wrens, GA 30833.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
