CONTAINED IN DEED TO SECURE DEBT

Pursuant to a power of sale contained in a certain Deed to Secure Debt, Assignment of Leases and Rents, Security Agreement and Fixture Filing executed by 5th Street Abercorn, LLC, hereinafter referred to as Grantor, to TRED IV, LLC recorded in Deed Book 3519, page 467, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said Deed to Secure Debt, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said Deed to Secure Debt and note secured thereby) will sell at the usual place of conducting Sheriff's sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in July 2026, all property described in said Deed to Secure Debt including but not limited to the following described property:
ALL those certain tracts or parcels of land situate lying and being in the City of Savannah, Chatham County, Georgia known as the remaining portions of Blocks 32 and 59 and the eastern portions of Blocks 31 and 60 and a portion of a former twenty foot lane located in Oakdale Subdivision, Mingledorff Ward described as follows: COMMENCING at an iron pipe set located at the intersection of the southern right-of-way line of Hampton Street and the western right-of-way line of Abercorn Street, which is the POINT OF BEGINNING; thence extending South 15 degrees 04 minutes West a distance of 335.02 feet to a point; thence extending South 72 degrees 39 minutes East a distance of 2.5 feet to a point; thence extending South 15 degrees 04 minutes West a distance of 115 feet to an iron pipe set; thence extending North 72 degrees 39 minutes West a distance of 450.50 feet to an iron pipe set; thence extending North 25 degrees 39 minutes 45 seconds East a distance of 249.93 feet to an iron pipe set; thence extending South 72 degrees 39 minutes East a distance of 455.50 feet to the POINT OF BEGINNING. Said property being more particularly described on that plat prepared by Hussey, Gay & Bell, C.E. for La Quinta Motor Inns, Inc. dated February 27, 1982, and recorded in Plat Cabinet P.B. Folio 145, in the Office of the Clerk of the Superior Court of Chatham County, Georgia.
AND, ALSO, all that certain lot, tract or parcel of land situate, lying and being in the State of Georgia, County of Chatham known as Parcel A of the Western Portion of Block 60, Oakdale Subdivision. Mingledorff Ward as shown on that certain plat prepared by James M. Sims, Georgia Registered Land Surveyor No. 2280, entitled "Plat of the Western Portion of Block 60 and a Portion of a Former 20 Foot Lane Right-of-Way, Oakdale Subdivision, Mingledorff Ward, Savannah, Chatham County, Georgia,” dated March 27, 1985, and recorded in the Office of the Clerk of Superior Court of Chatham County, Georgia in Plat Book 7-P, Page 20; said parcel being more particularly described as follows: COMMENCING at a concrete monument located at the point of intersection of the Southern line of the right-of-way of Hampton Street and the Eastern Line of the right-of-way for White Bluff Road, said point being the POINT OF BEGINNING; proceeding thence South 72 degrees 27 minutes 40 seconds East a distance of 90 feet along the Southern right-of-way line of Hampton Street to a concrete marker; proceeding thence South 15 degrees 27 minutes 51 seconds West a distance of 125.17 feet to a point; proceeding thence North 72 degrees 20 minutes 40 seconds West a distance of 89.51 feet to a concrete monument; proceeding thence North 15 degrees 14 minutes 10 seconds East a distance of 125 feet to the POINT OF BEGINNING. Sims, Georgia Registered Land Surveyor No. 2280, entitled "Plat of the Western Portion of Block 60 and a Portion of a Former 20 Foot Lane Right-of-Way, Oakdale Subdivision, Mingledorff Ward, Savannah, Chatham County, Georgia,” dated March 27, 1985 and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Plat Book 7-P. Page 20; said property being more particularly described as follows: COMMENCING at the point of intersection between the Southern right-of-way line of Hempton Street and the Eastern right-of- way line of White Bluff Road and proceeding thence South 72 degrees 27 minutes 40 seconds East a distance of 90 feet to a concrete monument which is the POINT OF BEGINNING; proceeding thence along the Southern right-of-way line of Hampton Street South 72 degrees 16 minutes 35 seconds East a distance of 69.64 feet to a point; proceeding thence South 14 degrees 47 minutes 42 seconds West a distance of 125.15 feet to a point; proceeding thence North 72 degrees 20 minutes 40 seconds West a distance of 71.10 feet to a point; proceeding thence North 15 degrees 27 minutes 51 seconds East a distance of 125.17 feet to the POINT OF BEGINNING. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Deed to Secure Debt.
