YOU ARE HEREBY SUMMONED AND REQUIRED to serve upon PELLEGRINO AND FELDSTEIN, LLC, plaintiff's attorneys, whose address is 290 Route 46 West, Denville, NJ, an Answer to the Amended Complaint filed in a Civil Action, in which CHRISTIANA TRUST AS CUSTODIAN GSRAN-Z, LLC is the plaintiff and ROBERT J. LAUER, JR., HIS HEIRS, ET ALS; are defendants, pending in the Superior Court of New Jersey, Chancery Division, OCEAN County and bearing Docket No. F-011704-25 within thirty-five (35) days after June 14, 2026 exclusive of such date. If you fail to answer or appear in accordance with Rule 4:4-6, Judgment by Default may be rendered against you for relief demanded in the Amended Complaint. You shall file your Answer and Proof of Service in duplicate with the Clerk of the Superior Court of New Jersey, Hughes Justice Complex - CN 971, Trenton, New Jersey 08625, in accordance with the Rules of Civil Practice and Procedure.
You are further advised that if you are unable to obtain an attorney you may communicate with the Lawyer Referral Service of the County of Venue and that if you cannot afford an attorney, you may communicate with the Legal Services Office of the County of Venue. THE ACTION has been instituted for the purpose of foreclosing the following tax sale certificate:
1. A certain tax certificate 23-00150, sold on 4/3/2023, dated 4/3/2023, and was recorded on 6/8/2023 in Mortgage Book 19399 at Page 1210, made by CRYSTAL M. BRINSON, Collector of Taxes of BARNEGAT TWP, and State of New Jersey to CHRISTIANA TRUST AS CUSTODIAN GSRAN-Z, LLC and subsequently assigned to plaintiff, CHRISTIANA TRUST AS CUSTODIAN GSRAN-Z, LLC. This covers real estate located in BARNEGAT TWP, County of OCEAN, and State of New Jersey, known as LOT 45.02 BLOCK 208 as shown on the Tax Assessment Map and Tax Map duplicate of BARNEGAT TWP. and concerns premises commonly known as 53 WATER ST, BARNEGAT TWP, New Jersey.
YOU, ROBERT J. LAUER, JR., HIS HEIRS, DEVISEES AND PERSONAL REPRESENTATIVES AND HIS, HER, THEIR OR ANY OF THEIR SUCCESSORS IN RIGHT, TITLE AND INTEREST; CHRISTINA LAUER, are made party defendant to the above foreclosure action because you are the owner of a property which is the subject of the above entitled action.
YOU, JOHN DOE, HUSBAND OF CHRISTINA LAUER, SAID NAME JOHN DOE BEING FICTITIOUS, are made party defendant to the above foreclosure action because plaintiff has been unable to determine whether defendant CHRISTINA LAUER is married, and if married, the name of CHRISTINA LAUER's spouse. If CHRISTINA LAUER is married, the plaintiff joins JOHN DOE, HUSBAND OF CHRISTINA LAUER, SAID NAME JOHN DOE BEING FICTITIOUS as a defendant for any possessory or marital rights you may have.
YOU, GARDEN STATE INVESTMENT, are made party defendant to the above foreclosure action because on May 18, 2011, Garden State Investment, recorded a Tax Sale Certificate bearing No. 11-00222 against Lauer, Robert J Jr, for a debt of $420.13, sold on May 11, 2011 for unpaid taxes/utility charges for the year(s) 2010 recorded in the OCEAN County Clerk's/Register's Office in Mortgage Book 14892 at page 467, dated May 12, 2011. Said lien is subordinate to the Tax Sale Certificate being foreclosed herewith.
YOU, CAZENOVIA CREEK FUNDING II, LLC, are made party defendant to the above foreclosure action because on July 22, 2019, Cazenovia Creek Funding II, LLC, recorded a Tax Sale Certificate bearing No. 19-00395 against Lauer, Robert J Jr, for a debt of $691.46, sold on June 26, 2019 for unpaid taxes/utility charges for the year(s) 2018 recorded in the OCEAN County Clerk's/Register's Office in Mortgage Book 17542 at page 966, dated June 26, 2019. Said lien is subordinate to the Tax Sale Certificate being foreclosed herewith.
YOU, ACB RECEIVABLES, are made party defendant to the above foreclosure action because on October 8, 2013, a judgment was entered in the Superior Court of New Jersey, Ocean County, by ACB Receivables against Robert Lauer disclosing a debt in the amount of $788.50, plus costs and interest. Said judgment was entered as Judgment No. DJ-205986-2013. Said judgment is subordinate to the Plaintiff's lien.
Defendants are hereby provided NOTICE of the right to exercise affirmative defense of surplus equity to this foreclosure action, per Tyler v. Hennepin, 598 U.S. 631 (2023).
A. If the plaintiff's lien is not redeemed, or you do not elect to have this action brought to sheriff's sale, you are at risk to lose your equity in the property.
B. The potential loss of equity in the Property is a valid basis to contest this matter; and
C. You have the right to request a sheriff's sale which would then require any surplus beyond the amount owed to plaintiff to be deposited with the Superior Court Trust Fund.
