NOTICE OF DECISION
On June 9, 2026, the City of Linden Planning Board (the "Planning Board") adopted a Resolution granting applicant, 1700 W. Elizabeth Owner, LLC (the "Applicant"), Preliminary and Final Major Site Plan approval with redevelopment plan deviation relief, for the property located at 1700 West Elizabeth Avenue, Linden, New Jersey, further identified as Block 426, Lots 2, 3 & 4 on the Tax Map of the City of Linden (the "Property").
The Planning Board approved the demolition of the existing restaurant and car dealership to replace them with a five-story residential building. The Board approved the construction of 80 residential units (4 studio apartments, 61 one-bedroom apartments, and 15 two-bedroom apartments) and associated parking. The Board also approved the following deviations from the Redevelopment Plan:
Penthouse Story Setback: Required: 8-10 ft, Approved: 0 ft for staircases;
Minimum Unit Size: Required: 800 sq ft, Approved: 4 units are less than 800 sq ft;
Primary Facade Surfaces: Required: 60% of each building façade, Approved: less than 60% for the front and right facade;
Wall-plane articulation: Required: at least every 40 feet, Approved: not present at base;
Street Trees: Required: Every 50 ft, Approved: less than 50 ft;
Foundation Plantings: Required: 50% of each street-facing façade, Approved: less than 50%;
Minimum Tree Size: Required: 3 inches, Approved: Less than 3 inches for certain trees;
Planted Buffer: Required: 10 ft, Approved: <10 ft against Lots 5, 6, and 7;
Maximum Sign Size: Allowed: 5 sq ft, Approved: 19 sq ft.
