NOTICE OF SALE UNDER POWER
STATE OF GEORGIA, COUNTY OF RICHMOND
By virtue of a Power of Sale contained in that certain Security Deed from On Your Terms LLC, a Florida Limited Liability Company to Mortgage Electronic Registration Systems, Inc., as a nominee for Kiavi Funding, Inc., its successors and assigns, dated July 26, 2024 and recorded on July 30, 2024 in Deed Book 1934, Page 2184 Instrument Number 2024021026, in the Office of the Clerk of Superior Court of Richmond County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of One Hundred Fifty-Two Thousand Six Hundred and 00/100 dollars ($152,600.00) with interest thereon as provided therein, as last transferred to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as owner trustee for the FLIC Residential Mortgage Loan Trust 1, recorded in Deed Book 1996, Page 2626, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in July, 2026, all property described in said Security Deed including but not limited to the following described property:
ALL THAT LOT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, FRONTING 100.0 FEET, MORE OR LESS, ON THE EAST SIDE OF DEANS BRIDGE ROAD AND EXTENDING BACK BETWEEN PARALLEL LINES A DISTANCE OF 235.0 FEET, MORE OR LESS. SAID PROPERTY IS DESCRIBED AS THE SOUTHERNMOST HALF OF PROPERTY SHOWN ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN REALTY BOOK 23-Q, PAGE 224. REFERENCE BEING MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION OF THE METES, BOUNDS AND LOCATION OF SAID PROPERTY. SAID PROPERTY CONVEYED SUBJECT TO PROTECTIVE COVENANTS RECORDED IN REALTY BOOK 23-D, PAGE 29, AS AMENDED, AND TO ANY APPLICABLE EASEMENTS, RESTRICTIONS, COVENANTS AND RIGHTS-OF-WAY OF RECORD IN AFORESAID CLERK'S OFFICE. THIS BEING THE SAME PROPERTY CONVEYED UNTO TERESA K. JOHNSON, BY DEED OF JOHNNY JOHNSON, DATED SEPTEMBER 16, 2003, RECORDED ON OCTOBER 9, 2003, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT FOR RICHMOND COUNTY, GEORGIA, IN BOOK 890, PAGE 1091. TAX MAP AND PARCEL: 128-0-006-02-0.

30815.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is Shellpoint Mortgage Servicing, 75 Beattie Place, Greenville, SC 29601, 1-800-365-7107.
Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are _ On Your Terms LLC and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code, 2) final confirmation and audit of the status of the loan with the holder of the Security Deed, and 3) any legal impediments to the undertaking and completion of sale.
The Financial Crimes Enforcement Network (“FinCEN”), a bureau of the U.S. Department of Treasury, now requires the collection, certification and reporting of certain information relating to non-financed transfers of real property to legal entities and/or trusts, which such information the successful bidder(s) shall be expected to provide to the auctioneer at the time of the subject sale.
