By virtue and in execution of the Power of Sale contained in a certain mortgage given by Joao C. De Araujo a/k/a Joao C. DeAraujo a/k/a Joao C. Araujo a/k/a Joao D. Araujo a/k/a Joao Araujo to World Savings Bank, FSB, a Federal Savings Bank, dated October 23, 2003 and recorded in Middlesex County Registry of Deeds in Book 41439, Page 64, of which mortgage the undersigned is the present holder by merger with World Savings Bank, FSB, a Federal Savings Bank, and Wachovia Mortgage, FSB effective December 31, 2007 under California Docket No. 12642 and a further merger with Wachovia Mortgage, FSB to Wells Fargo Bank Southwest, National Association, effective November 1, 2009 under North Las Vegas, Nevada, Docket No. 12642 and a subsequent merger with and into Wells Fargo Bank, National Association effective November 1, 2009 in Sioux Falls, South Dakota, Charter No. 1 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on July 14, 2026 at 1:00PM local time upon the premises 39 Williams St Framingham MA 01702, all and singular the premises described in said Mortgage, to wit:
THE LAND WITH THE BUILDINGS THEREON SITUATED IN FRAMINGHAM, MIDDLESEX COUNTY MASSACHUSETTS AT THE JUNCTION OF WILLIAMS STREET AND UNDERWOOD AVENUE AND BEING SHOWN AS LOTS 85, 86, AND 87 ON THE PLAN ENTITLED “PLAN OF SOMERSET PLAT” DATED AUGUST 1921 BY EDWARD H. HOWARD, CONS. ENG. WHICH PLAN IS RECORDED WITH MIDDLESEX SOUTH DISTRICT REGISTRY OF DEEDS IN PLAN BOOK 299, PLAN 11, AND SAID THREE LOTS ARE TOGETHER BOUNDED AND DESCRIBED AS FOLLOWS:
EASTERLY BY THE WESTERLY LINE OF UNDERWOOD AVENUE ON SAID PLAN, 60 FEET;
SOUTHERLY BY LOT 84 ON SAID PLAN, 95.5 FEET;
WESTERLY BY LOTS 71, 72 AND 70 ON SAID PLAN 60 FEET; AND
NORTHERLY BY THE SOUTHERLY LINE OF WILLIAMS STREET, 95.5 FEET.
BEING THE SAME PARCEL CONVEYED TO JAOA C. DEARAUJO FROM NOEL T. MURPHY AND TERESA C. MURPHY BY VIRTUE OF A DEED DATE 5/25/99 RECORDED 5/28/99 IN DEED BOOK 30228, PAGE 135 IN MIDDLESEX COUNTY, MASSACHUSETTS.
The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described.
TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof.
