MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage, given by Christopher Kyricos (the "Mortgagor"), to Hanscom Federal Credit Union, a lending institution, with a usual place of business at 25 Porter Road, Littleton, MA 01460 (the "Mortgagee"), dated August 13, 2022, and recorded at Plymouth Registry of Deeds in Book 57141, Page 321, (the "Mortgage"), of which Mortgage the undersigned is the present holder, for breach of the conditions of the Mortgage and for purposes of foreclosing the same will be sold at Public Auction at 11 o'clock AM on July 21, 2026 on the premises located at 643 Summer Street, Marshfield, Massachusetts, which are all and singular the premises described in the Mortgage, TO WIT: The Property known and numbered as 643 Summer Street, Marshfield, Plymouth County, Massachusetts bounded and described as follows: Beginning at the northerly corner of the premises conveyed, on said Summer Street, thence South 51 1/2° West by land formerly of Israel H. Macomber, two hundred thirty seven and 6/10 (237.6) feet to land now or formerly of Mary P. Sprague and others; thence South 28° East by land nor or formerly of said Sprague and others, one hundred eighty and 84/100 (180.84) feet to a corner of the lot; thence North 51 1/2° East, still by land of said Sprague and others, two hundred forty four and 2/10 (244.2) feet to said Summer Street; thence North 31° West by said Street, one hundred eighty and 84/100 (180.84) feet to the point of beginning; containing one acre more or less. Being the same premises obtained by Grantor through a Foreclosure Deed executed on August 25, 2016 and recorded at the Plymouth County Registry of Deeds on October 11, 2016 in Book 47579, Page 179. Being the same premises conveyed to Christopher Kyricos, an unmarried man by deed of The Bank of New York Mellon f/k/a The Bank of New York, as Trustee for the Certificate holders of the CWABS, Inc., Asset - Backed Certificates, Series 2006-8 recorded on 09/03/2021 with the Plymouth county recorder of deeds in Book/Volume 55605 Page 161 Instrument 00101088. For title reference, see the Release Deed recorded with the Plymouth County Registry of Deeds in Book 55605, Page 161, Document Number 00101088. The description of the premises contained in said Mortgage shall control in the event of a typographical error in this publication.
The premises being offered for sale will be sold subject to any and all restrictions, easements, covenants, conditions, agreements, outstanding tax titles, unpaid real estate taxes, and other municipal and public charges, assessments, liens or claims in the nature of liens, rights of others in adjacent streets and ways, and existing encumbrances of record created prior to the mortgage, if any there be, and also subject to all federal, state and municipal laws, regulations, codes and ordinances. Without limiting the generality of the foregoing, the premises being offered for sale will be sold subject to the following matters insofar as the same may be now in force and effect and applicable to said mortgaged premises: A mortgage in the original principal amount of $300,000.00 recorded with said Deeds in Book 55,605, Page 163.
TERMS OF THE SALE: A deposit of Five Thousand Dollars ($5,000.00) by bank or certified check, will be required to be paid by the highest bidder at the time and place of the sale and said bidder will be required to sign a Memorandum of Sale containing the above and any announced terms. The sale will not be complete until such deposit is paid and such Memorandum is signed. In the event the successful bidder at the public auction fails to perform in the time specified to purchase the premises, the Mortgagee reserves the right, at its sole election, to sell the premises by foreclosure deed to the other qualified bidders, in descending order beginning with the next highest bidder and reserves the right, at its sole election, to assume the bid of any defaulting or declining bidder. The Purchaser will be required to deliver the balance of the bid price by bank or certified check within thirty (30) days of the date of the auction sale, at the law firm of Gelinas Petersen Meyers Ryan & Court LLP, 106 Merriam Avenue, Leominster, MA 01453 at which time the foreclosure deed and all related documents will be delivered to the Purchaser. The Purchaser will be solely responsible for filing and recording foreclosure documents and for the payment of deed excise stamps and filing and recording fees. The Purchaser will be responsible for FinCEN reporting, unless there is an applicable exemption, and for any applicable Massachusetts Department of Revenue filing and withholding.
