NOTICE IS HEREBY GIVEN THAT THE BOARD OF TRUSTEES OF UNION TOWNSHIP, CLERMONT COUNTY, OHIO ADOPTED RESOLUTION NO. 2026-39 ON JUNE 9, 2026, REGULATING THE USE AND OPERATION OF SNOWMOBILES, OFF-HIGHWAY MOTORCYCLES, AND ALL-PURPOSE VEHICLES (“SPECIAL PURPOSE VEHICLES”) AS DEFINED IN CHAPTER 4519 OF THE OHIO REVISED CODE ON RESIDENTIALLY ZONED OR OCCUPIED PROPERTIES WITHIN UNION TOWNSHIP AND ADOPTING CIVIL FINES AND PENALTIES. RESOLUTION REGULATING THE USE AND OPERATION OF SNOWMOBILES, OFF-HIGHWAY MOTORCYCLES, AND ALL-PURPOSE VEHICLES (“SPECIAL PURPOSE VEHICLES”) AS DEFINED IN CHAPTER 4519 OF THE OHIO REVISED CODE ON RESIDENTIALLY ZONED OR OCCUPIED PROPERTIES WITHIN UNION TOWNSHIP AND ADOPTING CIVIL FINES AND PENALTIES
The Union Township Board of Trustees Clermont County, Ohio, met in regular session at the Union Township Civic Center, 4350 Aicholtz Road, Cincinnati, OH 45245 at 6:00 PM on June 9, 2026 with the following members present: Joe Dills, John Becker, and Michael Logue.
Mr. Becker moved to adopt the following Resolution: 2026-39
WHEREAS, Union Township, Clermont County, Ohio has adopted a limited home rule form of government pursuant to Chapter 504 of the Ohio Revised Code;
WHEREAS, R.C. 504.04 generally empowers the Township Board of Trustees to adopt and enforce within the Township’s unincorporated territory local police, sanitary, and other similar regulations that are not in conflict with general laws;
WHEREAS, R.C. 504.05 further empowers the Township to impose a civil fine for violation of a resolution adopted under R.C. Chapter 504, which civil fine may be graduated based on the number of previous violations of the same resolution (provided the fine does not exceed $1,000); and
WHEREAS, the Union Township Board of Trustees finds it necessary, and in the interests of the public health, safety and welfare, to adopt and enforce restrictions, limitations, and prohibitions regarding the time, manner, place, location, and operation of snowmobiles, off-highway motorcycles, and other similar all-purpose vehicles upon residentially zoned or utilized land within Union Township, Clermont County, Ohio as permitted pursuant to R.C Chapter 4519, inclusive, and to further impose civil penalties for the commission of offenses or violations of said restrictions, limitations, and prohibitions, in accordance with R.C. Chapter 504 and the provisions of this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Union Township, Clermont County, Ohio, as follows:
SECTION 1. For purposes of this Resolution, the following definitions shall apply:
A. “Platted Subdivision” shall be defined in accordance with the definition set forth in the Clermont County Subdivision Regulations.
B. The terms “Snowmobile,” “All-Purpose Vehicle,” and “Off-Highway Motorcycle” shall be defined in accordance with R.C. 4519.01.
C. “Special Purpose Vehicles” shall collectively refer to Snowmobiles, All-Purpose Vehicles, and Off-Highway Motorcycles.
D. References to “Township” territory shall mean the unincorporated territory of Union Township, Clermont County, Ohio.
SECTION 2. No person shall operate any Special Purpose Vehicle on any parcel in the Township in a manner that violates the provisions of R.C. 4519.40.
SECTION 3. No person shall operate any Special Purpose Vehicle upon any residentially zoned or utilized parcel within the Township if the parcel is less than two (2) acres in size.
SECTION 4. No person shall operate any Special Purpose Vehicle upon any residentially zoned or utilized parcel located within any Platted Subdivision in the Township.
SECTION 5. Any person may operate a Special Purpose Vehicle on any residentially zoned or utilized parcel that is larger than two (2) acres in size and not located in a Platted Subdivision, subject to the following conditions:
A. Special Purpose Vehicles shall not be used in the front yard or any side yard.
B. Use of Special Purpose Vehicles does not occur within two hundred (200) feet of any of the parcel’s lot lines.
C. Use of Special Purpose Vehicles shall not occur within five hundred (500) feet of any residential structure located on an adjacent parcel.
D. Any person operating a Special Purpose Vehicle pursuant to this Resolution shall be required to install and maintain dust control measures, consisting of all of the following:
1) The area(s) where the Special Purpose Vehicles are operated shall be watered down before, during, and after utilization as needed as to eliminate dust and other airborne debris.
2) The area(s) where the Special Purpose Vehicles are operated shall be completely surrounded and enclosed by a continuous berm or earthen mound, constructed to a height of not less than four (4’) feet, with said mound planted with two rows of coniferous evergreen trees, spaced ten (10’) feet on center, staggered, with such trees to be not less than twelve (12’) feet in height at the time of planting.
Failure to abide by these requirements while operating a Special Purpose Vehicle pursuant to this Resolution is hereby determined to constitute an “Objectionable, Noxious, or Dangerous Use, Practice, or Condition”, as defined within of Section 720 of the Union Township Zoning Resolution, subject to separate enforcement action as permitted pursuant to the Union Township Zoning Resolution and/or Chapter 519 of the Ohio Revised Code.
E. Not more than two (2) Special Purpose Vehicles shall be operated concurrently on a parcel otherwise authorized for the operation of Special Purpose Vehicles pursuant to this Resolution.
F. The operation of any vehicle regulated by this Resolution must cease for not less than one (1) hour for every hour of operation, intermittent, or continuous.
G. No Special Purpose Vehicle shall be operated upon any area used as a primary or secondary septic system leech field, or a drainage area, as so specified and otherwise regulated by Clermont County Public Health.
H. No Special Purpose Vehicle shall be operated within any public or private drainage, stormwater, or other watercourse easement area.
I. Special Purpose Vehicles may only be operated during the following times:
1. Monday-Friday: 9:00 am – 6:00 pm
2. Saturday: 10:00 am – 5:00 pm
3. Sunday: 12:00 pm – 5:00 pm
J. Nothing herein shall be interpreted as authorizing any commercial activity on a parcel unless such activity is permitted pursuant to the Union Township Zoning Resolution and any other applicable law.
K. Nothing herein shall be interpreted as exempting any Special Purpose Vehicle use from any permitting requirements that may appear in the Union Township Zoning Resolution.
L. Nothing herein shall be interpreted as exempting any Special Purpose Vehicle use or any other related activity from applicable noise and/or nuisance laws.
SECTION 6. Nothing in this Resolution shall prevent the use of an All-Purpose Vehicle on private property to haul, convey, or otherwise transport tools, materials, or other equipment necessary to facilitate the improvement, repair, or maintenance of said property, provided that such activities shall be conducted within the time periods specified within Section 5 hereof. An All-Purpose Vehicle may also be utilized for snow removal activities from driveways and vehicle travel areas located on private property, provided such operations are limited to removal of snow, treatment of icy conditions, or other similar activities, regardless of the hours of operation.
SECTION 7. Any violation of this Resolution shall be punishable with a civil fine in accordance with the following schedule:
First Offense: $100.00
Second Offense within 12 Consecutive Months: $500.00
Third Offense within 12 Consecutive Months: $1,000.00
Additional Offense(s) within 12 Consecutive Months: $1,000.00
SECTION 8. Any peace officer serving the Township may issue citations to persons who violate this Resolution in accordance with R.C. 504.06.
SECTION 9. Any person served with a citation for violation of this Resolution shall answer, and Union Township and/or a court of proper jurisdiction shall hold proceedings on, such citation in accordance with R.C. 504.07.
SECTION 10. A peace officer serving a citation for violation of this Resolution shall forward a copy of said citation to the Planning and Zoning Director for further inspection and follow-up enforcement, regarding the provisions of Section 5(D) of this Resolution.
SECTION 11. Nothing in this Resolution shall be construed as prohibiting, impairing, or restricting the Township’s ability to address the prohibited use or operation of any Special Purpose Vehicle through any other available legal action, remedy, or penalty under the Ohio Revised Code, Ohio common law, or any other local Township laws.
SECTION 12. A succinct summary of this Resolution shall be published in accordance with R.C. 504.121-.22
SECTION 13. It is hereby found and determined that all formal actions of this Board concerning and relating to the passage of this Resolution were taken in an open meeting of this Board, and all deliberations of this Board and any of its committees that resulted in such formal action were taken in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 14. The Board, by a majority vote of its members, hereby dispenses with the requirement that this Resolution be read on two separate days, and hereby authorizes the adoption of the Resolution upon its first reading.
SECTION 15. This Resolution shall be effective at the earliest date allowed by law.
