MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Stephen M. Colonna and Candace Cox to Wells Fargo Home Mortgage, Inc., dated September 25, 2002 and recorded in Plymouth County Registry of Deeds in Book 22969, Page 91 (the “Mortgage”) of which mortgage MidFirst Bank is the present holder by Assignment from Wells Fargo Bank, N.A., successor by merger to Wells Fargo Home Mortgage, Inc. to Nationstar Mortgage, LLC dated February 21, 2025 and recorded at said Registry of Deeds in Book 59713, Page 29, and Assignment from Nationstar Mortgage LLC to MidFirst Bank dated October 31, 2025 and recorded at said Registry of Deeds in Book 60512, Page 257, and Assignment from Nationstar Mortgage LLC to MidFirst Bank dated October 31, 2025 and recorded at said Registry of Deeds in Book 60533, Page 286, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 31 Samoset Street, Plymouth, MA 02360 will be sold at a Public Auction at 4:00 PM on July 7, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon situated on the northwesterly side of Samoset Street, Plymouth, Plymouth County, Massachusetts, more particularly bounded and described as follows:
SOUTHEASTERLY by Samoset Street, as shown on the hereinafter mentioned plan, 65.00 feet; SOUTHWESTERLY by land now or formerly of Mary L. J. Gordon, as shown on said plan, 100.00 feet; NORTHWESTERLY by Goddard Lane, as shown on said plan, 69.25 feet; and, NORTHEASTERLY by land now or formerly of Plymouth Area Investment Trust, as shown on said plan, 77.64 feet.
Being shown on a plan entitled "Plan of Land, Samoset Street, Plymouth, Massachusetts, Scale: 20 feet to an inch, November 13, 1984, Paul J. Knight, Registered Land Surveyor, 56 Griffin Terrace, Weymouth, Massachusetts" which plan is recorded with Plymouth County Registry of Deeds at Plan Book 5878, Page 84, as Plan No. 84-946.
Containing 5,600 square feet.
Subject to an easement to maintain a drain pipe shown on plan No. 946 of 1984, recorded at Book 5878, Page 84.
Subject to an easement to Town of Plymouth described in an instrument recorded at Book 8602, Page 349.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 19648, Page 20.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
