MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Joan M. Kowalski to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Allied Home Mortgage Capital Corp Branch 571, its successors and assigns, dated December 15, 2005 and recorded in Plymouth County Registry of Deeds in Book 31946, Page 86 (the “Mortgage”) of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCF 2 Acquisition Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Allied Home Mortgage Capital Corp Branch 571, its successors and assigns to Green Tree Servicing LLC dated March 17, 2014 and recorded at said Registry of Deeds in Book 44156, Page 161, and Assignment from Ditech Financial LLC F/K/A Green Tree Servicing LLC to New Residential Mortgage, LLC dated January 22, 2020 and recorded at said Registry of Deeds in Book 52253, Page 111, and Assignment from New Residential Mortgage, LLC to NewRez LLC D/B/A Shellpoint Mortgage Servicing dated March 11, 2021 and recorded at said Registry of Deeds in Book 54592, Page 190, and Assignment from NewRez LLC F/K/A New Penn Financial, LLC D/B/A Shellpoint Mortgage Servicing to U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCF 2 Acquisition Trust dated April 4, 2022 and recorded at said Registry of Deeds in Book 56706, Page 140, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 534 Twin Lakes Drive, of Twin Lakes Condominium IV, Halifax, MA 02338 will be sold at a Public Auction at 10:00 AM on July 7, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Unit No. 534 in Building No. 4-3 in a certain condominium known as the Twin Lakes Condominium IV, submitted to the provisions of Massachusetts General Laws, Chapter 183A, by virtue of Master Deed dated February 11, 1986 recorded with Plymouth County Registry of Deeds in Book 6585 Page 199.
An undivided 1.7088 percentage interest in the common areas or facilities of said condominium as set forth in said Master Deed which said percentage interest shall be subject to change in accordance with the provisions of the Master Deed.
Easements appurtenant to said Unit:
(i) for the existence and maintenance of encroachments within common areas of facilities;
(ii) for the use of utility and other common facilities;
(iii) for the use of Parking Space(s) designated for said Unit on the Twin Lakes Condominium IV Plans as space No(s); 5 and 6; and
(iv) for other purposes.
Subject to and with the benefits of conditions, covenants, restrictions, easements, limitations, terms, lien rights and provisions and charges as set forth in Master Deed of The Twin Lakes Condominium IV dated February 11, 1986 and recorded at Plymouth County Registry of Deeds in Book 6585 Page 199.
Subject to and with the benefits of conditions, covenants, restrictions, easements, limitations, reservations, terms, lien rights and provisions and charges, together with the by laws contained in the Twin Lakes Condominium IV Trust dated February 11, 1986 and recorded in the said Registry of Deeds in Book 6585, Page 250.
Terms and provisions of Massachusetts General Laws, Chapter 183A, as the same may have been amended and may be further amended from time to time.
The Post Office address of the Condominium is 534 Twin Lakes Drive, Halifax, MA 02338.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 24652, Page 86.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
