Permitted Activity: Storm water discharges to waters of the state from municipal separate storm sewer systems (MS4) that are owned, operated, and maintained by municipalities listed above.
Discharge Locations: From the municipal separate storm sewer systems of City of Brookfield, Village of Butler, Village of Elm Grove, Village of Germantown, City of Greenfield, Village of Menomonee Falls, City of Milwaukee, Milwaukee County, City of West Allis, Village of West Milwaukee, and City of Wauwatosa.
Receiving Waters: Waters of the state located within the Milwaukee River, Menomonee River, Kinnickinnic River, Fox River, Root River, Cedar Creek, Oak Creek, and Lake Michigan Watersheds.
Department of Natural Resources Determination: The Depart m e nt has m a de a preli m inary deter m ination to reissue WPDES Per m it No. WI- S065404-3. Require m e nts and conditions to protect the waters of the state in accordance with applicable state statutes and ad m inistrative codes are included in the proposed per m it.
WEPA Compliance Determination under s. NR 150.35(2), Wis. Adm. Code: Reissuance of WPDES Per m it No. WI- S065404-3 is a prior compliance action under s. NR 150.20(3)(a)8., Wis. Adm. Code.
Nature of Discharges Covered by the Permit: The proposed per m it contains the require m e nts set forth under Ch. NR 216, Wis. Ad m . Code, and the developed urban area perfor m ance standard specified in Ch. NR 151, Wis. Ad m . Code. The proposed per m it applies to discharges to waters of the state throughout the state of Wisconsin.
Permit Description (WPDES Permit No. WI- S065404-3): The Depart m e nt proposes to cover the storm water discharges for the City of Brookfield, Village of Butler, Village of Elm Grove, Village of Germantown, City of Greenfield, Village of Menomonee Falls, City of Milwaukee, Milwaukee County, City of West Allis, Village of West Milwaukee, and City of Wauwatosa under Per m it No. WI-S065404-3 after it is reissued. The MS4 per m it requires a regulated m unicipality to reduce pollutants that discharge through its MS4 to waters of the state via the develop m ent, i m ple m entation, and m a intenance of progra m s for pu b lic education and outreac h , public involve m e nt and participation, illicit discharge detect i on and eli m ination, const r uction site pollutant c ontrol, post-construction pollutant control, pollution prevention at its m unic i pal operations, and m eeting the developed urban area perfor m ance standard under Ch. NR 151, Wis. Ad m . Code. In addition, the per m it requires the develop m ent and updating of a storm sewer s y stem m a p and an annual report to the Depart m e nt. Furthermore, the proposed permit specifies special conditions to address the Milwaukee River TMDL goals.
