MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Steven M. Barry and Elise D. Barry to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for 1st Alliance Lending, LLC, its successors and assigns, dated May 25, 2017 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 57166, Page 202 (the “Mortgage”), as affected by a Loan Modification Agreement dated September 30, 2022, and recorded at said Registry of Deeds in Book 68488, Page 116 of which mortgage Rocket Mortgage, LLC f/k/a Quicken Loans, LLC f/k/a Quicken Loans Inc. is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for 1st Alliance Lending, LLC., its successors and assigns to 1st Alliance Lending, LLC dated September 26, 2018 and recorded at said Registry of Deeds in Book 59462, Page 108, and Assignment from 1st Alliance Lending, LLC to The Money Source Inc. dated May 31, 2019 and recorded at said Registry of Deeds in Book 60578, Page 246, and Corrective Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for 1st Alliance Lending LLC, its successors and assigns to 1st Alliance Lending, a Connecticut Limited Liability Company dated December 15, 2021 and recorded at said Registry of Deeds in Book 66843, Page 29, and Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for 1st Alliance Lending LLC, its successors and assigns to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for The Money Source Inc., its successors and assigns dated October 26, 2022 and recorded at said Registry of Deeds in Book 68488, Page 112, and Assignment from The Money Source Inc. to Mortgage Electronic Registration Systems, Inc., as mortgagee dated December 6, 2022 and recorded at said Registry of Deeds in Book 68577, Page 331, and Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for The Money Source Inc., its successors and assigns to Rocket Mortgage, LLC f/k/a Quicken Loans, LLC dated December 30, 2025 and recorded at said Registry of Deeds in Book 73034, Page 386, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 128 North Street, East Brookfield, MA 01515 will be sold at a Public Auction at 12:00 PM on July 8, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in East Brookfield, Worcester County, Massachusetts, being Lot No. 10 and the northerly one-third of Lot No. 9 as shown on plan entitled "Plan of Lots of Louis J. Muzzrall, East Brookfield, Massachusetts, July 1948, Theo. Drazek Surveyor" recorded with Worcester District Registry of Deeds, Plan Book 158, Plan 53 and more particularly bounded and described as follows:
BEGINNING at the north easterly corner thereof on the westerly side of North Street and the southeasterly corner of land now or formerly of Philip Prizzio, as shown on said plan;
THENCE southerly by the westerly side of North Street, 100 feet to a point;
THENCE N. 82° 42' W., 403 feet more or less by the southerly two-thirds of Lot #9 as shown on said plan to a ditch leading from Perry Pond to Mud Pond as shown on said plan;
THENCE northerly by the easterly side of said ditch 120 feet to an iron pin at land now or formerly of said Prizzio;
THENCE S. 79° 25' E, 400 feet, more or less, by the southerly line of said Prizzio to an iron pin at the place of beginning.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 57166, Page 200.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
