SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS on March 23, 2022, EARNESTINE MOORE, A SINGLE WOMAN, executed a Deed of Trust to PILGER TITLE CO., as Trustee , and MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., SOLELY AS NOMINEE FOR CALIBER HOME LOANS, INC, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Forrest County, Mississippi, in Book 2416, Page 517, as Instrument Number 835431; which Deed of Trust has been duly transferred and assigned to NewRez LLC D/B/A SHELLPOINT MORTGAGE SERVICING, as recorded on March 21, 2023, in Mortgage Book 2472, Page 715, as Instrument Number 849245, in the office of the Chancery Clerk of Forrest County, Mississippi.
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC d/b/a Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the Northeast Main Entrance of the Paul B. Johnson, Jr., Chancery Building, located at 641 North Main Street, at Hattiesburg, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on July 15, 2026, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee.
The premises to be sold are described as:
THE SOUTH 30 FEET OF LOT 4 AND ALL OF LOT 5 OF BLOCK 21 OF THE HATTIESBURG HEIGHTS PROPER SURVEY TO THE CITY OF HATTIESBURG, COUNTY OF FORREST, STATE OF MISSISSIPPI, AS PER THE MAP OR PLAT THEREOF ON FILE IN THE OFFICE OF THE CHANCERY CLERK OF FORREST COUNTY.
The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
