NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 89 Waleco Road, Brockton, MA 02302
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Timothy D Ellerbe to Navy Federal Credit Union, and now held by Navy Federal Credit Union, said mortgage dated September 22, 2023 and recorded in the Plymouth County Registry of Deeds in Book 58632, Page 310, for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on July 16, 2026 at 04:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A certain parcel of land with the buildings thereon situated on Waleco Road, Brockton, Plymouth County, Massachusetts, and being shown as Lot 6164 on a plan entitled "Revisions, Ashfield II, Owned by: Braintree Homes, Inc., Brockton, Mass., dated October 4, 1961, Bradford Saivetz & Associates, Inc., Consulting Civil Engineers", and recorded with Plymouth County Registry of Deeds as Plan No. 725 of 1961, to which plan reference is hereby made for a more particular description.
Containing 14,000 square feet of land, more or less.
Being all of that certain property conveyed to Timothy D. Ellerbe, individually, from Barbara I. Libby, a single woman, by deed dated December 16, 2016 and recorded December 16, 2016 in/as Instrument No. 2016 00114247 Book 47889 Page 171 of official records.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated December 16, 2016 and recorded in the Plymouth County Registry of Deeds in Book 47889, Page 171.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
Said mortgage is subject to a certain mortgage given by Timothy Ellerbe to Nationstar Mortgage LLC, dated December 16, 2016 and recorded in Plymouth County Registry of Deeds in Book 47889, Page 173.
Said mortgage is also subject to a UCC lien in favor of Sunnova SLA Management, LLC recorded on May 1, 2023 in Plymouth County Registry of Deeds in Book 57872, Page 309 as to its interest in the solar equipment collateral only, not the real property.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
