MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of that certain mortgage given by Joseph A. Kularski a/k/a Joseph A. Kularski, Jr., and Doris K. Johnson to North Brookfield Savings Bank, dated October 7, 2014, and recorded with the Worcester South District Registry of Deeds at Book 52909, Page 286, for breach of conditions of said mortgage and for the purpose of foreclosing the same, said premises, and the buildings thereon, will be sold at Public Auction at 10:00 A.M. on the 15th day of July, 2026, on the mortgaged premises at 107 South Street, East Brookfield, Massachusetts, all and singular, the premises described in said mortgage:
To Wit:
PARCEL 1:
The land in East Brookfield, Worcester County, Massachusetts, being a certain parcel of land situated on the easterly side of South Street and bounded and described as follows:
BEGINNING at an iron pin on the easterly side of South Street;
THENCE N. 5° 24’ E., by the easterly side of said South Street 66.3 feet to an iron pin at other land of the grantors;
THENCE S. 79° 42’ E., by other land of the grantors, 86.62 feet to an iron pin;
THENCE S. 67° 12’ E., still by other land of the grantors, 90.75 feet to an iron pin;
THENCE S. 39° 52’ W., still by other land of the grantors, 131.2 feet to an iron pin;
THENCE N. 23° 20’ W., by land now or formerly of Harry McCoy, 90 feet to an iron pin;
THENCE N. 87° 17’ W., by land of said McCoy, 56 feet to the place of beginning.

Land east of South Street in East Brookfield being shown as Parcel “A” on a plan entitled “Plan of Land in East Brookfield, MA owned by Helen A. Lamoureux, June 30, 1997, Donald A. Para, Land Surveyor, Inc. New Braintree, MA”, which plan is recorded with the Worcester District Registry of Deeds in Plan Book 717, Plan 39 and which lot is more particularly bounded and described as follows:
BEGINNING at a point which is 54 feet from the intersection of Kularski land as shown on said plan, the southwest corner of Lot “B” as shown on said plan and the easterly line of South Street along a course S. 76° 53’ 07” E.;
THENCE N. 70° 52’ E., 9.07 feet along Lot “B” to a point;
THENCE S. 83° 22’ E., 49.00 feet along said Lot “B” to an iron pin set;
THENCE S. 60° 41’ 22” E., 69.32 feet along said Lot “B” to a point;
THENCE N. 71° 13’ 02’ W., 90.75 feet to a point;
THENCE N. 76° 53’ 07” W., 32.62 feet to the point of beginning.
Being the same premises conveyed to Joseph A. Kularski a/k/a Joseph A. Kularski Jr., and Doris K. Johnson by deed of Joseph A. Kularski, Jr., Deborah M. Bissonnette, Stanley M. Kularski, William P. Kularski and Christopher J. Kularski dated October 27, 2009 and recorded with the Worcester District Registry of Deeds in Book 45089, Page 11.
TERMS OF SALE: $5,000.00 non refundable deposit shall be paid in cash or bank cashier's check by the purchaser at the time and place of sale, and the balance to be paid in cash or by certified or bank cashier's check at the office of Howard B. D’Amico, P.C., 33 Waldo Street, Worcester, Massachusetts, 01608, within 30 days of the sale. All bidders must exhibit said required deposit to the auctioneer immediately prior to the auction sale in order to qualify as a bidder.
Said premises will also be sold subject to and/or with the benefit of any and all rights of way, easements, restrictions, covenants, conditions, reservations and agreements of record, to the extent that the same are in force and applicable, outstanding taxes, tax titles, municipal or other public liens or assessments, water bills, sewer bills, liens or claims in the nature of liens, all existing encumbrances of record created prior to this mortgage, and the right of redemption of the United States of America, if any. It shall be the bidders’ sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning regulations. The mortgaged premises, if occupied, shall be conveyed subject to existing occupancies and/or tenancies.
This sale may be postponed or adjourned from time to time, if necessary, by the Attorney for the mortgagee at the scheduled time and place of sale.
Other terms, if any, to be announced at the sale. The successful bidder shall be required to sign a Memorandum of Terms and Conditions containing the above terms at the sale.
If the highest bidder fails to complete the purchase of the premises on the terms provided in this notice and in the Memorandum of Terms and Conditions signed following the sale, the Mortgagee reserves the right to sell the premises to the second highest bidder (or each subsequent highest bidder thereafter) who will then have five (5) days to deliver the deposit specified above to the Mortgagee's attorney as herein indicated, and to agree to a closing date for payment of the remaining balance of such subsequent highest bid and transfer of deed that is within thirty (30) days thereafter.
