MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Magdalene Oben and Gerald Tabi to CTX Mortgage Company, LLC, dated July 28, 2006 and recorded in Plymouth County Registry of Deeds in Book 33119, Page 140 (the “Mortgage”), as affected by a Reformation Order recorded at said Registry of Deeds in Book 50140, Page 144 of which mortgage U.S. Bank National Association, as Trustee for Asset Backed Securities Corporation Home Equity Loan Trust, Series MO 2006-HE6, Asset Backed Pass-Through Certificates, Series MO 2006-HE6 is the present holder by Assignment from CTX Mortgage Company, LLC to Nationstar Mortgage LLC dated August 10, 2006 and recorded at said Registry of Deeds in Book 35210, Page 139, and Assignment from Nationstar Mortgage LLC to U.S. Bank National Association, as Trustee for Asset Backed Securities Corporation Home Equity Loan Trust, Series MO 2006-HE6, Asset Backed Pass-Through Certificates, Series MO 2006-HE6 dated July 25, 2015 and recorded at said Registry of Deeds in Book 46295, Page 217, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 469 North Main Street a/k/a 469-471 North Main Street, Unit No. 469, of the 469-471 North Main Street Condominium, Brockton, MA 02301 will be sold at a Public Auction at 12:00 PM on July 10, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The unit ("Unit") known as 469 of the 469-471 North Main Street Condominiums, a condominium ("Condominium") established by L.M.P. Realty Enterprises LLC, a Massachusetts Limited Liability Company, of 80 Satucket Avenue, East Bridgewater, Massachusetts pursuant to Massachusetts General Laws, Chapter 183A, by Master Deed dated July 26, 2006, recorded with Plymouth County Registry of Deeds in Book 33090, Page 74 ("Master Deed"), which Unit is shown on the floor plans ("Plans") of the Building recorded simultaneously with the Master Deed.
The Unit is conveyed together with:
1. An undivided interest of 50% in the common areas and facilities ("Common Elements") of the Condominium described in the Master Deed attributable to the Unit.
2. Exclusive use of Parking Spaces numbered 5 and 6 for registered motorized vehicles only and use in common with the other condominium owners of Parking Spaces numbered 3 and 4 for visitor parking only as shown on the plans recorded with the aforementioned Master Deed.
3. An easement for the continuance of all encroachments by the Unit on any adjoining units or Common Elements existing as a result of construction of the Building, or which may come into existence hereafter as a result of settling or shifting of the Building, or as a result of repair or restoration of the Building or of the Unit after damage or destruction by fire or other casualty, or after a taking in condemnation or eminent domain proceedings, or by reason of an alteration or repair to the Common Elements made by or with the consent of the Trustees.
4. An easement in common with the owners of other units to use any pipes, wires, ducts, flues, cables, conduits, public utility lines, and other Common Elements located in any of the other units or elsewhere in the Condominium and serving the Unit.
5. Rights and easements in common with other Unit Owners as described in the Master Deed.
Said Unit is conveyed subject to:
(1) Easements in favor of adjoining units and in favor of the Common Elements for the continuance of all encroachments of such adjoining units or Common Elements on the Unit, now existing as a result of construction of the Building, or which may come into existence hereafter as a result of settling or shifting of the Building, or as a result of repair or restoration of the Building or of any adjoining unit or of the Common Elements after damage or destruction by fire or other casualty, or after a taking in condemnation or eminent domain proceedings, or by reason of an alteration or repair to the Common Elements made by or with the consent of the Trustees.
(2) An easement in favor of the other units to use the pipes, wires, ducts, flues, conduits, cables, public utility lines, and other Common Elements located in the Unit or elsewhere in the Condominium and serving such other units.
(3) The provisions of this Unit Deed, the Master Deed, the Declaration of Trust, and the Plans, as the same may be amended from time to time by instrument recorded with the Plymouth County Registry of Deeds, which provisions, together with any amendments thereto, shall constitute covenants running with the land and shall bind any person having at any time any interest or estate in the Unit, his family, servants, and visitors, as though such provisions were recited and stipulated at length herein.
(4) All easements, agreements, restrictions and conditions of record, insofar as the same are now in force and applicable.
The Unit is intended only for residential purposes, and no other use may be made of the Unit.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 33119, Page 138.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
