ORDINANCE NO. 26-298
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF LITCHFIELD PARK, MARICOPA COUNTY, ARIZONA, DECLARING THE FOLLOWING DOCUMENT A PUBLIC RECORD "ACCESSORY STRUCTURES – AMENDMENTS TO DEFINITIONS AND GENERAL PROVISIONS FOR ACCESSORY STRUCTURE"; AMENDING THE ZONING CODE OF THE CITY OF LITCHFIELD PARK, ARIZONA, SECTION 2, DEFINITIONS, AS IT PERTAINS TO SCREENING OF ACCESSORY STRUCTURES, AND SECTION 31, GENERAL PROVISIONS, AS IT PERTAINS TO ACCESSORY STRUCTURES; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR PENALTIES; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Litchfield Park, Arizona (the "City") regulates the allowable land uses within the corporate limits of the City; and,
WHEREAS, the private use of backyard spaces have been utilized for accessory structures and have impacted homeowners and adjacent neighbors, and the City Council desires to update its Zoning Code to coincide with such changes and updates.
NOW THEREFORE, BE IT ORDAINED by the Council of the City of Litchfield Park, Arizona, as follows:
Section I. Declaration of Public Record.
That certain documents entitled "Accessory Structures – Amendments to Definitions and General Provisions for Accessory Structures" attached hereto as Exhibit "A," three copies of which are to remain on file in the office of the City Clerk, is hereby declared to be a public record and said copies are to remain on file with the City Clerk.
Section II. In General.
The Zoning Code of the City of Litchfield Park, Arizona, Section 2, Definitions, and Section 31, General Provisions, are hereby amended as provided for in that certain public record entitled "Accessory Structures – Amendments to Definitions and General Provisions," attached hereto as Exhibit "A."
Section III. Housing Impact Statement.
The City has considered the impact this Zoning Code text amendment may have on housing as provided for in the attached Zoning Housing Impact Form, attached hereto as Exhibit "B" and incorporated herein.
Section IV. Providing for Repeal of Conflicting Ordinances.
All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the Code adopted herein by reference are hereby repealed.
Section V. Providing for Severability.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
Section VI. Providing for Penalties.
The procedures and penalties set forth in Section 8, Violations, Enforcement and Penalties of the Litchfield Park Zoning Code, for violations of the Zoning Code, a zoning ordinance, a use permit, a variance or a design review approval shall apply to violations of this Ordinance, and are incorporated herein. A violation of this Ordinance shall also constitute a public nuisance. In addition to issuance of a civil citation or criminal citation pursuant to Section 8 of the Zoning Code, the code enforcement officer is authorized to abate the nuisance and charge the cost to the property owner following the procedures set forth in Article 9-5 of the City Code.
Section VII. Effective Date.
This Ordinance shall be effective from 30 days after the date written below.
