MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Roy M. Correia to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Residential Mortgage Services, Inc., its successors and assigns, dated September 24, 2021 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 66168, Page 44 (the “Mortgage”) of which mortgage Rocket Mortgage, LLC s/b/m Nationstar Mortgage LLC is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Residential Mortgage Services, Inc., its successors and assigns to Nationstar Mortgage, LLC dated December 3, 2025 and recorded at said Registry of Deeds in Book 72917, Page 71, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 59 H Foote Road, Charlton, MA 01507 will be sold at a Public Auction at 4:00 PM on July 14, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land in Charlton, Worcester County, Massachusetts, bounded and described as follows:
NORTHWESTERLY by the Southeasterly sideline of H. Foote Road, a way with a variable width situated in the Town of Charlton, as shown on a plan of land hereinafter mentioned, by three lines measuring, respectively, 137.09 feet, 255.93 feet and 64.74 feet; and
NORTHEASTERLY by land now or formerly of Ide, 515.61 feet; and
SOUTHEASTERLY By land now or formerly of Mark L. Shaevel, Trustee, by three lines measuring respectively 32.92 feet, 313 feet and 270.65 feet; and
SOUTHERLY by land now or formerly of Mark L. Shaevel, Trustee, 341.51 feet.
Containing an area of 4.77 acres, more or less, and being shown on a plan of land entitled "Plan of Land owned by Robert E. Nelson & William T. Smith H. Foote Road Charlton, Massachusetts Scale 1"= 40' August 15, 1997 Prepared by Jim Kasierksi, PLS, Inc. 6 Setting Sun Drive, Westerly, Rhode Island 02891", which plan is duly recorded in Plan Book 719, Page 81, Worcester County Registry of Deeds.
Such land is also shown as LOT 1 and LOT 2 on a plan of land entitled: "Charlton, MA. Plan of Land Prepared for: Steven Backus Scale: 1" = 60' Date: April 25, 1988 New World Development & Engineering PO Box 595 Route 31 Charlton, MA 01508", which plan is duly recorded in Plan Book 602, Page 18, Worcester County Registry of Deeds.
The above-described premises are conveyed subject to and with the benefit of all rights, rights of way, easements, reservations and restrictions of record, if any there be and insofar as the same are in force and effect.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 61728, Page 230.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
