In execution of the Deed of Trust in the original principal amount of $10,518.85 dated April 27, 2006 and recorded in Book 708, Page 292 as Instrument No.060002041, of the County of Dinwiddie land records, the appointed Substitute Trustee will offer for sale at public auction at the main entrance of the Dinwiddie County Courthouse located at 14008 Boydton Plank Road, Dinwiddie, VA 23841 on July 27, 2026 at 12:30 PM, the property described in said deed of trust, located at the above address and more particularly described as follows:
All that certain parcel of land in, Dinwiddie County, Commonwealth of VA, as more fully described in Book 120 Page 253 ID# 21-D-2-F-35, being known and designated as Lot 35-39, Block F, Section 2 Dinwiddie Gardens, filed in Plat Book 2 at Page 92-A.
More Particularly described on the above listed deed as follows:
All those certain lots or parcels of land with the improvements thereon and appurtenances thereto belonging, lying in Namozine Magisterial District, Dinwiddie County, Virginia, near the City of Petersburg, Virginia, and designated as Lots Nos. Thirty-five (35), Thirty-six (36), Thirty-seven (37), Thirty-eight (38) and Thirty-nine (39), in Block "F" on a plat of Section Two (2) of DINWIDDIE GARDENS, made by J.W. Pugh, Engineer, dated June 1952, which recorded in the Clerk's Office of the Circuit Court of Dinwiddie County, Virginia, in Plat Book 2 at pages 92-A; said lots have an aggregate frontage of 125 feet on the western side of Glendale Avenue and extend back between parallel lines 165.0 feet as shown on said plat; and being in all respects the same property conveyed to the parties of the first part by deed from Marvin D. Goodrich, et al., dated August 30, 1955, and of record in the aforesaid Clerk's Office in Deed Book 93 at page 53.
Being the same property conveyed by fee simple deed from Vernard E. Simmons and Virginia E. Simmons to Loid A Hodnett and Leetha Cain Hodnett, dated 07/07/1964 recorded on 07/13/1964 in Book 120, Page 253 in Dinwiddie County Records, Commonwealth of VA.
Subject to all restrictions, rights of way, easements and other conditions contained in deed forming the chain of title to the caption property.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.
TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
