Under and by virtue of a Power of Sale contained in that certain Deed of Trust executed by Randolph K. Eberhardt, Mortgagor(s), in the original amount of $86,111.00, to Mortgage Electronic Registration Systems, Inc., ("MERS") as beneficiary, as nominee for CMC Funding, Inc., Mortgagee, dated March 1st, 2013 and recorded on March 6th, 2013 in Book 548, Page 757, Madison County Registry.
Default having been made in the payment of the note thereby secured by the said Deed of Trust and the undersigned, Anchor Trustee Services, LLC having been substituted as Trustee in said Deed of Trust by an instrument duly recorded in the Office of the Register of Deeds of Madison County, North Carolina, and the holder of the note evidencing said indebtedness having directed that the Deed of Trust be foreclosed, the undersigned Substitute Trustee will offer for sale at the courthouse door or other usual place of sale in Madison County, North Carolina, at 10:00 AM on July 9th, 2026, and will sell to the highest bidder for cash the following described property, to wit:
Beginning at a P.K. nail set in the intersection of Old N.C. 213,State Road 1616, and an existing gravel road known as Riley Forester Road, said point being the beginning corner in Deed Book 239 at Page 573, of the Madison County Register's Office, thence North 62°50'46" East 165.80 feet; thence North 79°53'44" East 52.80 feet; thence South 58°34'32" East 118.15 feet; thence North 73°28'39" East 136.80 feet; thence South 15°12'89" East 62.30 feet; thence South 68°53'19" East 315.85 feet; thence South 84°40'59" East 526.76 feet; thence South 46°40'41"West 289.78 feet; thence North 63°00'00" West 430.07 feet; thence South 86°14'58" West 86.12 feet; thence South 85°06'52" West 295.53 feet; thence North 05°11'28" West 109.98 feet; thence North 48°02'28" West 59.54 feet; thence North 89°14'21" West 279.41 feet to the point of Beginning, containing 2.588 acres, more or less, as shown on a survey prepared by Danny R. Tolar Associates, P.A., dated March 16, 1996.
And being all of that property described in Book 171, at Page 417 of the Madison County Register's Office, less and excepting all of that property described in Book 239, at Page 573 of the aforesaid registry.
Together with improvements located hereon; said property being located at 160 Sunset Mountain Road, Mars Hill, NC 28754

Third party purchasers must pay the recording costs of the trustee’s deed, any land transfer taxes, the excise tax, pursuant North Carolina General Statutes §105-228.30, in the amount of One Dollar ($1.00) per each Five Hundred Dollars ($500.00) or fractional part thereof, and the Clerk of Courts fee, pursuant to North Carolina General Statutes §7A-308, in the amount of Forty-five Cents (0.45) per each One Hundred Dollars ($100.00) or fractional part thereof with a maximum amount of Five Hundred Dollars ($500.00). A deposit of five percent (5%) of the bid or Seven Hundred Fifty Dollars ($750.00), whichever is greater, will be required at the time of the sale and must be tendered in the form of certified funds. Following the expiration of the statutory upset bid period, all the remaining amounts will be immediately due and owing.
Said property to be offered pursuant to this Notice of Sale is being offered for sale, transfer and conveyance AS IS WHERE IS. There are no representations of warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at, or relating to the property being offered for sale. This sale is made subject to all prior liens, unpaid taxes, special assessments, land transfer taxes, if any, and encumbrances of record. To the best of the knowledge and belief of the undersigned, the current owner(s) of the property is/are The Estate of Randolph K. Eberhardt.
PLEASE TAKE NOTICE: An order for possession of the property may be issued pursuant to North Carolina General Statutes §45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of the county in which the property is sold.
