CITATION GIVING NOTICE OF
PETITION TO PARTITION
In the matter of:
Petition to Partition Unit D-1-84 Claire Drive, Stoughton, MA
To Susan Primak of Stoughton in said County, Estate of Richard Primak and Estate of Fred Primak and to all other interested persons, a petition has been presented to said Court by
Jeffrey Primak of Baltimore in the State of Maryland representing that they hold as tenant in common a 25% undivided part or share of certain land lying in Stoughton in the County of Norfolk, and briefly described as follows :84 Claire Drive, Unit No D-1, that certain condominium unit known as Unit No. D-1-84, 84 D-1 Claire Drive of Knollsbrook Condominium Nine in Stoughton, Norfolk County, Massachusetts, a Condominium established by the Workingmens Cooperative Bank pursuant to Massachusetts General Laws, Chapter 183A by Master Deed dated May 19, 1977 and recorded with Norfolk County Registry of Deeds on May 24, 1977 in Book 5335, Page 1, as amended ("Master Deed") which is shown on the floor plans of the building filed simultaneously with the Second Amendment to said Master Deed, recorded on July 7, 1078, Book 5484, Page 361 and on the copy of the portion of said plans attached to the first Unit deed thereof, to which is affixed the verified statement of a registered engineer in the form required by Section 9 of said Chapter 183A, for full description see petition on file. Setting forth that they desire that all of said land may be sold at private sale or public auction for not less than four hundred thirty thousand ($430,000.00) and praying that partition may be made of all the land aforesaid according to law, and to that end, that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the court finds cannot be advantageously divided, either at private sale or public auction, and be ordered to distribute and pay over the net proceeds thereof in such manner to make the partition just and equal.
If you desire to object thereto you or your attorney should file a written appearance and answer in said Court at Canton before ten o'clock in the forenoon on the twenty-ninth day of July, 2026 the return day of this citation.
