NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Misty Bowman and Trevell D. Perry to Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Southpoint Financial Services, Inc., its successors and assigns dated December 11, 2023, and recorded in Deed Book 3267, Page 277, Chatham County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Planet Home Lending LLC, securing a Note in the original principal amount of $710,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, August 4, 2026, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that certain lot, tract or parcel of land situate, lying and being in the 7th G.M. District, Chatham County, Georgia, and being known and designated as LOT NUMBER ONE THOUSAND ONE HUNDRED NINETY-THREE (1193), SOUTHBRIDGE AT BERWICK PLANTATION, PHASE II-B, upon a map or plan of said Subdivision entitled "A Subdivision Plat of Southbridge at Berwick Plantation, Phase II- B, Lots 1191-1271, Containing Portions of Tracts "F-2B" and a Portion of Tract "F-1" (Shown as Future Development #3 on Phase 1-A) of the C&S Tract Known as Berwick Plantation, 7th G.M.D., Chatham County, Georgia", prepared for Southbridge Development by Chad W. Carpenter, G.R.L.S. No. 2979 with Thomas & Hutton Engineering Co., dated June 24, 2005, and recorded in Subdivision Map Book 33-S, Page(s) 9-A, B, C, D and E, in the Office of the Clerk of the Superior Court of Chatham County, Georgia records. Said map or plat is hereby incorporated herein and made a part of this description by specific reference thereto for a more complete description of the herein described and conveyed property. Said property containing improvements located thereon more commonly known under the present numbering system as 85 Woodchuck Hill Road, Savannah, Georgia 31405; and having a Chatham County Tax P.I.N. of 1-1008F-01-166.
This being the same property conveyed from SugarMagnolia Homes, LLC to Brockton W. Baker and Jocelyn A. Baker by that certain Warranty Deed dated October 31, 2006, and recorded in Deed Book 315-X, Page 140, in the Office of the Clerk of the Superior Court of Chatham County, Georgia records.
Subject, however, to all valid zoning ordinances, restrictions, covenants, easements, and rights-of-way of record or evidenced by use.
Said property is known as 85 Woodchuck Hill Road, Savannah, GA 31405, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Misty Bowman and Trevell D. Perry, successor in interest or tenant(s).
