NOTICE OF FORECLOSURE SALE
Notice is hereby given that Special Master Margaret Lake will offer for sale and sell to the highest bidder for cash the real property described as follows:
Lot 3, WESTMORELAND PARK SUBDIVISION, in the City of Las Cruces, Dona Ana County, New Mexico, as shown and designated on the plat thereof, filed in the Office of the County Clerk of said County on September 24, 2013, in Book 23 Page(s) 511-512 of Plat Records.
(the "Property").
The sale shall commence at 10:00 a.m. on August 4, 2026 outside the main entrance of the Third Judicial District Courthouse, 201 W. Picacho, City of Las Cruces, County of Dona Ana, State of New Mexico. The Property will be sold to the highest bidder for cash to pay expenses of sale and to satisfy the sums decreed to be owed to Dr. Majdi Ashchi ("Plaintiff") by a Default and Stipulated Judgment, Decree of Foreclosure, Order of Sale, and Appointment of Special Master, entered June 12, 2026 (the "Judgment") in the above-entitled cause, being an action to foreclose a judgment lien on the Property.
The balance due under the Judgment is the principal sum of $460,562.95, bearing post-judgment interest from December 10, 2024 at the rate of 9.50%, adjusted annually as set forth in Fla. Stat. § 55.03. The balance due under the Judgment including interest to date of sale will be $529,178.00.
The Court further ordered that Plaintiff is allowed to credit bid any portion of the money judgment on the Property, in his sole discretion.
The sale of the Property will be for cash or cash equivalents, payable immediately. Plaintiff may be a purchaser at the sale and may bid, in his sole discretion, any amount of his money judgment, the same as cash, on the Property. Plaintiff may submit to the Special Master written credit bids prior to the sale. The Special Master is authorized to postpone the sale from time to time without further notice or publication, in her discretion.
Notice is further given that the purchaser at the foreclosure sale shall take title to the Property subject to a nine-month right of redemption; prior reservations, restrictions, easements, rights-of-way, water rights, ditch rights, accrued and unpaid ad valorem taxes owed on the Property, and other such matters of record, if any. The sale described in this Notice is subject to the terms of the Judgment.
