NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated September 12, 2001, executed by JEFFERY M KELLY and CHRISTY C KELLY conveying certain real property therein described to BILL R MCLAUGHLIN & EMMETT JAMES HOUSE, as Trustee, for UNION PLANTERS BANK NATIONAL ASSOCIATION, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the Office of the Chancery Clerk of Forrest County, Mississippi filed and recorded September 20, 2001, in Book 1167, Page 376; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to REGIONS BANK D/B/A REGIONS MORTGAGE; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on August 14, 2026 within the lawful hours of sale between 11:00AM and 4:00PM at the Northeast Rear Entrance of the Paul B. Johnson Chancery Building, 641 North Main Street, Hattiesburg, MS 39401 proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Forrest County, Mississippi, to wit:
BEGINNING AT THE NW CORNER-OF THE SW 1/4 OF NE 1/4, SECTION 28, TOWNSHIP 4 NORTH, RANGE 12 WEST, FORREST COUNTY, MISSISSIPPI FOR THE POINT OF BEGINNING; RUN EAST 660 FEET; THENCE RUN SOUTH 330 FEET; THENCE RUN WEST 660 FEET; THENCE RUN NORTH 330 FEET OR BACK TO THE POINT OF BEGINNING; CONTAINING 5 ACRES, MORE OR LESS.
PROPERTY ADDRESS: The street address of the property is believed to be 140 JOHN EVANS RD, PETAL, MS 39465. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed, and (3) purchaser’s tendering to Rubin Lublin, LLC, anti-money laundering information as required pursuant to the FinCEN Real Estate Report Rule. Failure to provide information, could result in rescission of the sale.
