NOTICE OF FORECLOSURE SALE
ETOWAH COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Micah A. Birdwell, an unmarried man to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for First Federal Bank, A FSB, dated May 12, 2025, and recorded in Book 2025 at Page 3591796 on May 13, 2025, in the Office of the Judge of Probate of Etowah County, Alabama, as last transferred to Freedom Mortgage Corporation by assignment, recorded on May 7, 2026, in Book 2026, at Page 3608673 in the Office of the Judge of Probate of Etowah County, Alabama, conveying the after-described property to secure a Note in the original principal amount of One Hundred Eighty-Nine Thousand Three Hundred Ninety-Three and 0/100 dollars ($189,393.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on August 5, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Etowah County, Alabama, within the legal hours of sale, the following described property:
Begin at a Mag Nail set in Neely Norma Lane marking the Southwest corner of Lot 21 of the Subdivision of the Joseph Warren James Land on the Jackson Trail Heights as recorded in Plat Book "C", pages 48-49, Etowah County, Probate Office and run North 11º29'10" West along the Easterly right-of-way line of Rockledge Road (Jackson Highway) a distance of 154.24 feet to an existing rebar with a destroyed cap; thence leaving said right-of-way line run North 78°30'31" East a distance of 114.05 feet to an iron pin found with cap stamped BURGETT CA-0078; thence run South 10°10'44" East a distance of 171.09 feet to an existing bent rebar under the pavement of Neely Norma Lane, said point being on the South line of Lot 21; thence run South 87°10'57" West along the South line of Lot 21 a distance of 111.42 feet to the point of beginning.
Said parcel of land being a portion of Lots 19, 20 and 21 of the Subdivision of the Joseph Warren James Land on the Jackson Trail Heights as recorded in Plat Book "C", Pages 48-49, Etowah County Probate Office, being subject to the right-of-way of Neely Norma Lane, also being subject to any easement rights for utilities lying on or over said property, lying and being in Etowah County, Alabama.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

To the best knowledge and belief of the undersigned, the party in possession of the property is Micah A Birdwell or tenant(s); and said property is more commonly known as 800 Rockledge Rd, Attalla, AL 35954.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
