RESOLUTION NO. 10578 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INDIO DECLARING ITS INTENTION TO VACATE A PORTION OF MADISON STREET ON THE NORTHWEST CORNER OF MADISON STREET AND HIGHWAY 111 AND FIXING THE TIME AND PLACE FOR PUBLIC HEARING OF ALL PERSONS INTERESTED IN OR OBJECTING TO THE PROPOSED VACATION WHEREAS, the City Council of the City of Indio does hereby declare its intention to vacate the public roadway in accordance with the procedures contained in Chapter 3 of the Public Streets, Highways and Service Easements Vacation Law (Streets and Highways Code Section 8320 eq. seq.); and WHEREAS, the public roadway intended to be vacated is a portion of Madison Street on the northwest corner of Madison Street and Highway 111, is more particularly described in Exhibits “A” and “B”, which are incorporated herein by reference. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF INDIO HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1 . That it intends to, and by this Resolution does, initiate proceedings pursuant to the Public Streets, Highways, and Service Easements Vacation Law, codified in Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California to vacate a portion of Madison Street on the northwest corner of Madison Street and Highway 111. Section 2 . That these proceedings will assist the City in confirming its assessment that the action in question, i.e., the vacation of a portion of Madison Street on the northwest corner of Madison Street and Highway 111, is in the public's interest as in the City's abandonment of a portion of Madison Street on the northwest corner of Madison Street and Highway 111. Section 3 . That the portion of said street right-of-way to be vacated is described in Exhibits “A” and “B” (vacation plan) attached hereto and made a part hereof by this reference. Also, the City will retain a public utility easement over the entire area being vacated. Section 4 . That the hour of 5:00 p.m. on the 15th day of July, 2026, and the Council Chambers at 100 Civic Center Drive, Indio, California, are hereby fixed as the time and place for the hearing of evidence from any person(s) interested in, or objecting to, the proposed vacation of said street right-of-way. Section 5 . That the City Clerk is hereby instructed to publish this resolution, providing notice of said hearing to the public, once weekly, for at least two successive weeks prior to said hearing, in the Desert Sun Newspaper. Section 6 . That the Director of Public Works for the City of Indio or his designee is hereby instructed to conspicuously post notices of vacation along the line of the portions of the street/right-of-way proposed to be vacated. The notices shall be at least three in number and shall be posted at least two weeks before the day set for the hearing not more than 300 feet apart.
