Petition to Partition Citation (A.C.92A)
To: Elaine Ashton Rosati and to all other persons interested.
A petition has been presented to said Court by Peter W Rosati of Ashburnham in the County of Worcester representing that he hold as tenant in common undivided part or share of certain land lying in Hopedale in said County Worcester and briefly as follows:
245-247 Mendon Street, Hopedale
Parcel One
A parcel of land together with the buildings thereon situated in Hopedale and Mendon, Massachusetts, and shown on "Plan on Land in Mendon & Hopedale, Mass., owned by Angelo Pagani” dated October, 1962, by Eastman & Corbett Inc., Civil Engineers, Milford, Mass., recorded in Worcester District Deeds in Plan Book 271, Plan 68, bounded and described on said plan as follows: -
Beginning at a point on the westerly side of Mendon Street in Hopedale, Worcester County, Massachusetts at the southeasterly corner of the granted premises, said point being fifty-three (53) feet distant from a Worcester County highway bound at the Mendon-Hopedale town line,
Thence N. 17° 18' 24" E. along the westerly line of Mendon Street, one hundred forty-eight and 01/100ths (148.01) feet to a stake;
Thence N. 69° 23" 50" W. by other land of the Estate of Filomena Paganini, one hundred seventy-nine and 11/100ths (179.11) feet through an iron pipe to a stake at other land of the Estate of Filomena Paganini,
Thence S 23° 51' 30" W. by other land of the Estate of Filomena Paganini, one hundred fifty-six and 83/100ths (156.83) feet to a drill hole in a wall at 8 Rod Road, so called;
Thence S. 51° 11' 20" E. along said 8 Rod Road, sixty-one and 42/100ths (61.42) feet to a point;
Thence N. 17° 18' 24" along land of Millard Pagani, seventy-five (75) feet to a stake;
Thence S. 51° 11' 20" E. along land of said Millard Pagani, one hundred and fifty (150) feet to the point of beginning.
Containing 23,690 square feet, according to said plan.
Parcel Two
A certain parcel of land, including all buildings thereon, situated partly in Hopedale and partly in Mendon, in said County, on the northwesterly side of Mendon Street, formerly "West Main Street" and bounded and described as follows, to wit:-
Beginning at the southerly corner of the granted premises on the northwesterly side of said Mendon Street at land formerly of Mary A. Broughey;
Thence northeasterly by the northwesterly side of said street 75 feet to land now or formerly of Pistro and Filomena Pagani;
Thence N. 35° 50' W. by last mentioned land 150 feet to an angle;
Thence S.31' W. by last mentioned land 75 feet to said Broughey land, and
Thence S. 35' 50" E. by last mentioned land 150 feet to the point of beginning.
Eight Rod Road Parcels, Mendon
Two parcels of land in Mendon, Worcester County, Massachusetts on the northeasterly side of Eight Rod Road, being more particularly bounded and described as follows:
Parcel One:
The property known as 78 Eight Rod Road and 76 Milford Street in Mendon, shown on the Mendon Assessors Map as Parcel 6-124-78 and Parcel 6-177-76, bounded and described as follows:
BEGINNING at a point on the northeasterly side of Eight Rod Road 150 feet N. 35° 50' East from the westerly side of Mendon Street, at the southwesterly corner of Parcel Two described herein;
THENCE N. 31° E. to a point in the town line with Hopedale;
THENCE northwesterly along the Hopedale/Milford town line and other land of Rosati to a point in the easterly side of Eight Rod Road at Town Bound #12 and land now or formerly of Paganini;
THENCE S. 33° 15' E. E. 167.3 feet, more or less, along Eight Rod Road;
THENCE S. 38° 35" E. 138 feet still along Eight Rod Road to the point of beginning.
Being shown on a plan recorded with the Worcester District Registry of Deeds at Plan Book 59, Plan 52.
Including but not limited to 1800 sq. feet of land, more or less, shown on a plan recorded with the Worcester District Registry of Deeds at Plan Book 271, Plan 68.
Parcel Two:
The property known as 74 Milford Street in Mendon, shown on the Mendon Assessors Map as Parcel 6-177-74, bounded and described as follows:
BEGINNING at a point on the northeasterly side of Eight Rod Road at the junction of the northwesterly side of Milford Street;
THENCE N. 35° 50' W. along Eight Rod Road 150 feet, more or less;
THENCE N. 31° E. by Parcel One described herein to the town line with Hopedale;
THENCE southeasterly along the town line with Hopedale and other land of Rosati to a point in the northwesterly side of Mendon Street; northwesterly side of Mendon Street to the point of beginning.
THENCE southerly along the northwesterly side of Mendon Street to the point of beginning.
Containing 4,500 square feet, more or less.
Being shown on Plan Book 59, Plan 52 and also being shown on Plan Book 271, Plan 68.
For title see deeds recorded with the Worcester District Registry of Deeds in Book 4754, Page 430; Book 5062, Page 516; and in Book 42352, Page 282.
setting forth that he/she desire that all the aforesaid described part of said land my be sold at private sale not less than Seven Hundred Fifty Thousand ($750,000.00)_dollars, and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be dvantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Worcester before ten o'clock in the forenoon on the 21st day of July the return day of this citation.
