YOU ARE HEREBY SUMMONED AND REQUIRED to serve upon PELLEGRINO AND FELDSTEIN, LLC, plaintiff's attorneys, whose address is 290 Route 46 West, Denville, NJ, an Answer to the Complaint filed in a Civil Action, in which SEASIDE CAPITAL LLC is the plaintiff and PETER W. THORNE, ET ALS; are defendants, pending in the Superior Court of New Jersey, Chancery Division, MONMOUTH County and bearing Docket No. F-010643-25 within thirty-five (35) days after July 2, 2026 exclusive of such date. If you fail to answer or appear in accordance with Rule 4:4-6, Judgment by Default may be rendered against you for relief demanded in the Complaint. You shall file your Answer and Proof of Service in duplicate with the Clerk of the Superior Court of New Jersey, Hughes Justice Complex - CN 971, Trenton, New Jersey 08625, in accordance with the Rules of Civil Practice and Procedure.
You are further advised that if you are unable to obtain an attorney you may communicate with the Lawyer Referral Service of the County of Venue and that if you cannot afford an attorney, you may communicate with the Legal Services Office of the County of Venue. THE ACTION has been instituted for the purpose of foreclosing the following tax sale certificate:
1. A certain tax certificate 20170021, sold on 10/18/2017, dated 10/23/2017, and was recorded on 1/12/2018 in Mortgage Book 9267 at Page 6621, made by SUSAN C. DAVISON, Collector of Taxes of HOWELL TWP, and State of New Jersey to TOWNSHIP OF HOWELL and subsequently assigned 988 LAKEWOOD FARMINGDALE ROAD, LLC and was recorded on 6/22/2021 in Assignment Book 9521 at Page 9437 and subsequently assigned to plaintiff, SEASIDE CAPITAL LLC on 7/28/2021 and was recorded on 7/30/2021 in Assignment Book 9531 at Page 8997. This covers real estate located in HOWELL TWP, County of MONMOUTH, and State of New Jersey, known as LOT 1 BLOCK 41 as shown on the Tax Assessment Map and Tax Map duplicate of HOWELL TWP. and concerns premises commonly known as SQUANKUM ROAD, HOWELL TWP, New Jersey.
YOU, LINDA P. THORNE, are made party defendant to the above foreclosure action because you are the owner of a property which is the subject of the above entitled action.
YOU, MRS. PETER W. THORNE, WIFE OF PETER W. THORNE; JOHN DOE, HUSBAND OF LINDA P. THORNE, SAID NAME JOHN DOE BEING FICTITIOUS, are made party defendant to the above foreclosure action because plaintiff has been unable to determine whether defendant PETER W. THORNE; LINDA P. THORNE is married, and if married, the name of PETER W. THORNE; LINDA P. THORNE's spouse. If PETER W. THORNE; LINDA P. THORNE is married, the plaintiff joins MRS. PETER W. THORNE, WIFE OF PETER W. THORNE; JOHN DOE, HUSBAND OF LINDA P. THORNE, SAID NAME JOHN DOE BEING FICTITIOUS as a defendant for any possessory or marital rights you may have.
YOU, 988 LAKEWOOD FARMINGDALE ROAD LLC, are made party defendant to the above foreclosure action because on April 2, 2003, Peter W. Thorne and Linda P. Thorne, executed a mortgage to Shrewsbury State Bank in the amount of $196,000.00, which mortgage was recorded on April 9, 2003 in the MONMOUTH County Clerk's/Register's Office in Mortgage Book 8214 at page 1133. Said mortgage is subordinate to the Plaintiff's lien.
On June 29, 2018 the aforesaid mortgagee assigned all its right, title and interest in and to said Mortgage to 988 Lakewood Farmingdale Road LLC by way of Assignment of Mortgage of that date, which Assignment of Mortgage was recorded in the MONMOUTH County Clerk's/Register's Office on January 16, 2019 in Book 9331 of Assignment of Mortgages at page 3926.
AND you, 988 LAKEWOOD FARMINGDALE ROAD LLC, are further made party defendant to the above foreclosure action because on November 19, 2004, Peter W. Thorne, executed a mortgage to Shrewsbury State Bank in the amount of $150,000.00, which mortgage was recorded on December 9, 2004 in the MONMOUTH County Clerk's/Register's Office in Mortgage Book 8241 at page 1623. Said mortgage is subordinate to the Plaintiff's lien.
On June 29, 2018 the aforesaid mortgagee assigned all its right, title and interest in and to said Mortgage to 988 Lakewood Farmingdale Road LLC by way of Assignment of Mortgage of that date, which Assignment of Mortgage was recorded in the MONMOUTH County Clerk's/Register's Office on January 16, 2019 in Book 9331 of Assignment of Mortgages at page 3933.
YOU, WBL SPO I LLC, are made party defendant to the above foreclosure action because on May 19, 2016, a judgment was entered in the Superior Court of New Jersey, Monmouth County, by WBL SPO I LLC against Peter W Thorne and Everett H Thorne Co Inc disclosing a debt in the amount 702,840.75, plus costs. Said judgment was entered as Judgment No. J-085138-2016. Said judgment is subordinate to the Plaintiff's lien.
YOU, ROOFERS AND WATERPROOFERS RESEARCH AND EDUCATION JOINT TRUST FUND, are made party defendant to the above foreclosure action because on
Defendants are hereby provided NOTICE of the right to exercise affirmative defense of surplus equity to this foreclosure action, per Tyler v. Hennepin, 598 U.S. 631 (2023).
A. If the plaintiff's lien is not redeemed, or you do not elect to have this action brought to sheriff's sale, you are at risk to lose your equity in the property.
B. The potential loss of equity in the Property is a valid basis to contest this matter; and
C. You have the right to request a sheriff's sale which would then require any surplus beyond the amount owed to plaintiff to be deposited with the Superior Court Trust Fund.
