NOTICE OF SUIT
To the defendant named below herein, and any other person who may be concerned.
You are notified that you have been sued in the Court named above.
The Plaintiff seeks a declaration from the Court that Plaintiff’s proposed use of the following described real estate does not violate the restrictions contained in the deed from the Defendant, Manchester Tank & Equipment Co., to JDMCC Properties, LLC:
A part of Lot 9 in Sunset Addition, Lawrence County, Indiana, a suburban Addition to the City of Bedford, lying in Section 15, Township 5 North, Range 1 West, as the same as shown on the plat of Sunset Addition, recorded in Plat Book 1, at page 214 and 248, in the Office of Recorder of Lawrence County, Indiana, more specifically described as follows: Beginning at the Northwest corner of Lot 9, said corner being marked by a 5/8 inch diameter rebar with a cap marked “Curry 890006” (called “monument” for the remainder of this description) set; thence on the North line of said Lot 9, North 89 degrees 09 minutes 07 seconds East (basis of bearings being Deed Record 218, page 482, Office of the Recorder) 125.00 feet to a monument set on the East line of said Lot 9; thence on the said East line, South 00 degrees 09 minutes 00 seconds East 272.71 feet to a monument set on the North line of Tenth Street (Deed record 250, page 2 and 5, Office of the Recorder); thence on said North line, South 18 degrees 50 minutes 00 seconds West 42.49 feet (formerly record distance of 42.22 feet) to a monument set; thence South 82 degrees 28 minutes 36 seconds West 112.10 feet to a monument set on the West line of said lot 9; thence on said West line, North 00 degrees 09 minutes 00 seconds West 325.75 feet to the point of beginning containing within said bounds 0.908 acres be the same more or less but subject to all rights-of-way and easements according to a survey by Douglas R. Curry, Registered Surveyor No. 890006 in October, 1996.
Also, a part of Lot 10 in Sunset Addition, Lawrence County, Indiana, a suburban Addition to the City of Bedford, lying in Section 15, Township 5 North, Range 1 West, as the same shown on the Plat of Sunset, recorded in Plat Book 1, at page 214 and 248 in the Office of Recorder of Lawrence County, Indiana, more specifically described as follows: Beginning at the Southwest corner of Lot 10, said corner being marked by a 5/8 inch diameter rebar with a cap marked “Curry 890006” (called “monument” for the remainder of this description) set; thence on the West line of said Lot 10, North 00 degrees 09 minutes 00 seconds West (basis of bearings being Deed Record 218, page 482, Office of the Recorder) 340.40 feet to a monument set on the North line of said Lot 10; thence on said North line, North 89 degrees 09 minutes 07 seconds East 125.00 feet to a monument set on the East line of said Lot 10; thence on said East line, South 00 degrees 09 minutes 00 seconds East 325.75 feet to a monument set on the North line of Tenth Street (Deed Record 250, page 2 and 5, Office of the Recorder); thence on said North line, South 82 degrees 28 minutes 36 seconds West 126.03 feet to the point of beginning containing within said bounds 0.956 acres be the same more or less.
This summons by publication is specifically directed to the following defendant who may claim some interest in the Real Estate and whose whereabouts are not known with certainty:
Manchester Tank
& Equipment Co.
You must respond to this summons by publication, by you or your attorney, on or before thirty (30) days after the Third Notice of Suit has been published. If you fail to do so, a default judgment may be entered for the relief demanded in the Complaint.
You may be entitled to a settlement conference that will allow you to speak with the Plaintiff and discuss alternatives. If you want a settlement conference, you must request it with the court within thirty (30) days after you received this summons.
