By virtue of a Writ of Execution #2481 CV 2949 issued by the Middlesex Superior Court, wherein Frank P. Valentino is named Judgment Creditor and Matthew E. Procek is named Judgment Debtor, having levied upon, seized and taken all the right, title and interest the said Matthew E. Procek had not exempt by law from levy, seizure or attachment, in and to the reai estate in the Town of Falmouth described in Book 29530 Page 119 at the Barnstable County Registry of Deeds as follows: Property Address: 112 Edgewater Drive East, East Falmouth, MA 02536:
A certain parcel of land with the buildings thereon situated in Falmouth (Waquoit) Barnstable County, Massachusetts and being further described as follows:
NORTHERLY by Leonard Drive as shown on a plan thereinafter mentioned, a distance of sixty-seven and 49/100 (67.49) feet;
NORTHEASTERLY by the junction of said Leonard Drive and Cross Road as shown on said plan, on a curve having a radius of twenty and 00/100 (20.00) feet and a distance of twenty-five and 55/100 (25.55) feet;
EASTERLY by said Cross Road, as shown on said plan, a distance of seventy-six and 61/100 (76.61 ) feet;
SOUTHERLY by portion of Lot No. 14 as shown on said plan, a distance of one hundred fifteen and 00/100 (115.00) feet; and
WESTERLY by Lot No. 16 as shown on said plan, a distance of one hundred twenty-four and 86/100 (124.86) feet.
Being shown as LOT 13 on a plan of land entitled "Subdivision Plan of Land in Falmouth in Waquoit for Frank L. Elkin, Scale of 50 feet to the inch, December 13, 1966, John P. Doyle, R.L.S." which plan is duly filed at the Barnstable Registry of Deeds in Plan Book 211, Page 5.
On Tuesday, August 4, 2026 at 1:00pm at the Barnstable County Sheriff's' Civil Process Office, 3261 Main Street, Barnstable, MA, I will sell the said right, title and interest at public auction, to the highest bidder, to satisfy this Execution, together with all costs and fees thereon. A deposit of $5,000.00 by cash, certified check or bank check will be required to be paid by the purchaser at the time and place of the sale. The balance is to be paid by certified check or bank check within thirty (30) days from the date of sale. The property will be sold subject to existing encumbrances and liens, including tax liens, if any.
NOTICE REGARDING ON-SITE SEWAGE DISPOSAL SYSTEMS
You are hereby notified that Massachusetts Regulations (Title 5 Regulations) require an inspection of on-site sewage disposal systems when there is a transfer of title to real estate. Any purchaser or transferee of real estate served by an on-site sewage disposal system is obligated to inspect, and if necessary, to upgrade a system in accordance with the provisions of 310 Code of Massachusetts Regulations (CMR). You are hereby referred to 310 CMR 15.300-15.305 for time periods to do so and other requirements. The Barnstable County Sheriffs Civil Process Office has no information about whether the real estate in question is served by an on-site sewage disposal system.
