STATEMENT OF CHARGES
COMES NOW the Iowa Board of Barbering and Cosmetology Arts and Sciences (“Board”) and files this Notice of Hearing and Statement of Charges against NaToyia S. Claytor, also known as NaToyia Winters (“Respondent”), currently located at 1017 Bullard Court, Suite 103, Raleigh, NC 27615, pursuant to Iowa Code §§ 17A.12(2), 17A.18(3), and 272C.3(1)(e) (2022), and Iowa Administrative Code rule 481—945.2.
A. TIME, PLACE AND NATURE OF HEARING
1. Hearing. A contested case hearing shall be held virtually starting at 9:00 a.m. CST on July 30, 2026. You must be able to utilize the video-function and be on camera for the duration of the hearing. This case has been delegated to the Administrative Hearings Division. 2. Answer. Within twenty (20) days of the date Respondent is served this Notice of Hearing and Statement of Charges, Respondent may file an Answer pursuant to rule 481—506.12(2) of the Iowa Administrative Code. In that Answer, Respondent should also state whether Respondent requests a continuance of the date and time of the hearing.

4. Presiding Officer. The Iowa Board of Barbering and Cosmetology Arts and Sciences voted unanimously to delegate this matter to the Administrative Law Judge from the Administrative Hearings Division of the Department of Inspections, Appeals and Licensing, to hear this disciplinary matter as well as any pre-hearing matters which may be filed by any parties. The Administrative Law Judge shall serve as presiding officer at the contested case hearing, as well as make initial rulings on prehearing matters.
5. Prehearing Conference. Any party may request a prehearing conference to discuss evidentiary issues related to the hearing in accordance with Iowa Administrative Code rule 481—506.17.
6. Hearing Procedures.The procedural rules governing the conduct of the hearing are found in rule 481—506.19 of the Iowa Administrative Code. At the hearing, Respondent may appear personally or be represented by legal counsel at Respondent’s expense. Respondent will have the opportunity to respond to the charges, to produce evidence relevant to issues of material fact, to cross-examine witnesses present at the hearing, and to examine and respond to any documents introduced at hearing. If you need to request an alternative time or date for hearing, you must comply with the requirements of Iowa Administrative Code rule 481—506.18. The hearing may be open to the public or closed to the public at the discretion of the Respondent.

The parties must file and exchange witness and exhibit lists, as well as copies of all proposed exhibits, at least five days prior to the hearing date, by using the Administrative Electronic Management System (adminhearings.iowa.gov/efile/) or by emailing the Administrative Hearings Division at

B. LEGAL AUTHORITY AND JURISDICTION
11. Iowa License. Respondent holds Iowa Nail Technologist license number 070293, which expired on March 31, 2026.
12. Jurisdiction.The Board has jurisdiction in this matter pursuant to Iowa Code §§ 17A, 157, and 272C and Administrative Code chapter 481—945.
13. Legal Authority. If any of the allegations against Respondent are determined to be founded, the Board has authority to take disciplinary action against Respondent under Iowa Code §§ 17A.12(2), 17A.18(3), and 272C.3(1)(e), and Iowa Administrative Code chapters 481—504, 481—506, and 481—945.
14. Default. The Board may enter a default decision or proceed with the hearing and render a decision in Respondent’s absence, in accordance with Iowa Code § 17A.12(3) and Iowa Administrative Code rule 481—506.21.
C. STATEMENT OF CHARGES
COUNT I
15. Respondent is charged under 645 Iowa Administrative Code 63.18(1) (2022)1 for the possession and use of a substance deemed hazardous or deleterious by the FDA for use in cosmetic products. Prohibited products include liquid methyl methacrylate monomer. The presence of a prohibited product in a salon is prima facie evidence of that product’s use in the salon.
D. STATEMENT OF THE MATTERS ASSERTED
16. Allegations. The Board reviewed and approved a short and plain Statement of the Matters Asserted (Statement) at the time this Notice of Hearing and Statement of Charges was filed. The Statement shall be furnished to Respondent as an attachment to this Notice of Hearing and Statement of Charges. However, the Statement is not a public record pursuant to Iowa Code § 272C.6(4)(a).

E. SETTLEMENT

F. PROBABLE CAUSE FINDING
18. On February 16, 2026, the Iowa Board of Barbering found probable cause to file
this Notice of Hearing and Statement of Charges.
