PUBLIC HEARING NOTICE
TOWNSHIP OF WAYNE ZONING BOARD OF ADJUSTMENT
COUNTY OF PASSAIC
PLEASE TAKE NOTICE that on July 20, 2026, at 7:30 p.m. at the Council Chambers of the Township of Wayne Municipal Building, 475 Valley Road, Wayne, New Jersey 07470, the Township of Wayne Zoning Board of Adjustment will hold a public hearing on an application filed by Yitzchok Handler (hereinafter sometimes referred to as the "Applicant") seeking bulk variance relief for construction of a two-story addition with a four-car garage and deck onto the existing single-family residence. Applicant will also seek any and all additional relief identified throughout the application process, including but not limited to: use or bulk variances, exceptions or waivers.
The property is located at 7 Colombo Lane, Wayne, New Jersey, and identified as Block 1202, Lot 86, in the R-15 Medium Density Residential Zoning District.
The Applicant resides at the property as the owner/operator of Handler Appliance, Inc., which is a company that repairs and services commercial and residential appliances. The Applicant, a tradesman, operates an administrative office and stores its commercial vehicles at the Property, but performs services entirely away from the dwelling unit. The Applicant's company employs three individuals who reside at the site, all of whom are family members. Home occupations or professions are a permitted use in the zone, and § 134-34.1(D)(4) permits the office of a tradesperson whose field activities are conducted entirely away from the dwelling unit.
The Applicant is seeking bulk variance relief to construct a two-story addition with a four-car garage. Specifically, Application requires bulk variance relief from § 134-67.1(B) because the proposal does not comply with the following standards:
Variances Required
1. § 134-67.1B: Commercial and other vehicles. No more than one commercial vehicle, vehicle registered as a school bus, or limousine may be parked, stored or garaged overnight. Here, the proposed two-story addition with a four-car garage is proposed to park, store, or garage up to three (3) commercial vehicles overnight. Thus, bulk variance relief is required. In the event this triggers a "d(1)" use variance or a "d(3)" conditional use variance, then Applicant will seek the same.
2. One additional variance was identified as front yard impervious coverage. To the extent the proposed front yard impervious coverages triggers a bulk variance, Applicant will seek the same.
Submission Waivers Required
The following submission waivers are required:
1. § 134-111.1.2.b2: For decks: 15 deck construction plans.
2. § 134-111.1.23: Flood plain (if applicable).
3. § 134-111.1.24: Wetland areas (if applicable).
Applicant will also seek any and all additional relief identified throughout the application process including but not limited to: other use or bulk variances, exceptions or waivers.
The application is on the referenced Zoning Board of Adjustment's public hearing agenda to be held on July 20, 2026, at 7:30 p.m. at the Township of Wayne Council Chambers, Township Hall, 475 Valley Road, Wayne, New Jersey 07470, at which time any interested person or persons may have an opportunity to be heard, either in person or by attorney, and present any statement and/or evidence they may have with respect to this application.
When this case is called, you may appear either in person or by an attorney and present any comments or objections which you may have to the granting of relief sought in the application. Any interested party may appear at said hearing and participate therein in accordance with the rules of the Township of Wayne Zoning Board of Adjustment.
In addition, the Township of Wayne Zoning Board of Adjustment intends to broadcast the meeting. Television access will be available on the local cable T.V. channel and on the Township of Wayne's website.
The application and physical documents are on file in the office of the Township of Wayne Planning Department, Municipal Building, 475 Valley Road, Wayne, New Jersey 07470, and is available for inspection by interested persons weekdays during regular office hours (between 8:30 A.M. and 4:30 P.M. Monday through Friday and until 7:30 P.M. Tuesdays). This notice is being published by the Applicant as required by the State of New Jersey's Municipal Land Use Law (NJSA 40:55D-10 and 12).
