ARIZONA BILTMORE ESTATES VILLAGE ASSOCIATION, an Arizona nonprofit corporation, Plaintiff(s),
vs.
HOWARD SIMON and JANE DOE SIMON, husband and wife; THE UNKNOWN HEIRS AND DEVISEES OF THE ABOVE-NAMED DEFENDANTS, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 23rd day of April, 2026, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 6th day of January, 2026, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, Howard Simon, as follows:
The amount of the Judgment was $6,928.31 plus interest on the unpaid balance at the rate of 10.00%, per annum from the date of Judgment; Interest accrues at the rate of $1.90 per day as to the total judgment (principal and the attorneys’ fees and costs). As of April 1, 2026, which represents 85 days since entry of judgment, total interest accrued is $161.50; Post Judgment attorneys’ fees and costs incurred to date total $663.00; and Unpaid Assessment imposed post Judgment total $0.00 and accrue annually; Unpaid late fees on assessments incurred post Judgment total $38.50.
Taking into consideration payments made subsequent to the entry of Judgment in the total amount of $0.00 to date, costs to date, accrued interest to date, and further unpaid assessments, the total amount due on that Judgment is $7,791.31, plus accruing interest, assessments, late charges, attorneys’ fees and costs, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 21, TALIVERDE UNIT ONE, according to Book 186 of Maps, page 37, records of Maricopa County, Arizona (“Lot 21”).
AKA: 2415 E. Luke Ave. Phoenix, AZ 85016.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 23rd day of July, 2026, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
