STATE OF NEW JERSEY TO: WILLIAM SOIFER, his heirs, devisees and personal representatives and his, hers, their, or any of their successors in right, title and interest; MRS. WILLIAM SOIFER, wife of William Soifer; LAKEWOOD SCHOOLS LLC, a limited liability company of the State of New Jersey; UNKNOWN OWNERS OR CLAIMANTS, his or her heirs, devisees and personal representatives and his, hers, their or any of their successors in right, title and interest; and the STATE OF NEW JERSEY. YOU ARE HEREBY SUMMONED and required to serve upon David B. Venino, Attorney for the Plaintiff, whose address is 700 Boston Blvd., Sea Girt, NJ 08750-0024, Tel. No. (732) 449-2153, an Answer to the Complaint filed in a civil action in which A Tax Lien Funding LLC, etc. is the Plaintiff and William Soifer, etc., et al. are the Defendants, now pending in the Superior Court of New Jersey, within 35 days after the date of the publication of this Notice, exclusive of such date. If you fail to do so, judgment by default may be entered against you for the relief demanded in the plaintiff's Complaint. You shall file your answer or motion, a completed Case Information Statement (available from the Clerk of the Superior Court) and proof of service in duplicate with the Clerk of the Superior Court, Hughes Justice Complex, P.O. Box 971, Trenton, NJ 08625, in accordance with the Rules of Civil Practice and Procedure. A $175.00 filing fee payable to "Treasurer, State of New Jersey" must accompany your answer or motion. The answer or motion should identify this suit by the caption and docket number above. You must also send a copy of your answer or motion to the plaintiff's attorney, whose name and address appear above. A telephone call will not protect your rights. You must file and serve a written answer or motion (with the $175.00 filing fee and completed Case Information Statement) if you want the Court to hear your defense. This action has been instituted for the purpose of foreclosing Tax Sale Certificate No. 22-00056 issued by the Lakewood Township Tax Collector to Breckenridge Properties, LLC dated October 11, 2022 and recorded in the Ocean County Clerk's Office on November 2, 2022 in Official Record Book 19212 at Page 1587 etc.; and which lists the assessed owner as "Jerman, Todd M et als" and affects lands and premises known as Lot 87 in Block 190 as shown on the tax duplicate of the Township of Lakewood, NJ (no street address); which certificate was assigned to the plaintiff by Assignment of Tax Sale Certificate dated March 16, 2026 and recorded on March 23, 2026 in the Ocean County Clerk's Office in Official Record Book 20320 at Page 1434 etc. A copy of the plaintiff's Complaint will be provided to you upon request. You and each of you are made defendants in the above titled action because you have, or may claim to have, some right, title, lien or other interest affecting the real estate being foreclosed by virtue of ownership, inheritance, descent, intestacy, devise, legacy, dower, curtesy, mortgage, deed of conveyance, entry of judgment or other legal or lawful right. You are advised of the right to exercise the affirmative defense of surplus equity to this foreclosure action pursuant to Tyler v. Hennepin County, 598 U.S. 631 (2023) and/or New Jersey Statute. Accordingly, the owner or the owner's heirs have the right to demand, in writing to the Superior Court before the date final judgment is entered, that the foreclosure proceed to a judicial sale as in the manner of a foreclosure of a mortgage or (if available) an Internet auction of the premises, through the office of the county sheriff; and, specifically: if the plaintiff's lien is not redeemed, or you do not elect to have this action brought to sheriff's sale, you are at risk of losing your equity in the premises; the potential loss of equity in the premises is a valid basis to contest this action; and you have the right to request a sheriff's sale which would require any surplus beyond the amount due to the plaintiff to be deposited with the Trust Fund of the Superior Court, for which any parties entitled thereto may make application for their appropriate share.
