PUBLIC NOTICE
Please take notice that Charles D. Resenly (the Applicant) has filed an Application For Development with The Borough of Haddonfield Zoninjg Board of Adjustment ("The Board") regarding Real Property located at 200 Lakeview Avenue and designated as Block 51, Lot 1 on the municipal tax map. The property is located in the R-8 (Residential-8) Zoning District where Single-Family Detached Homes are a permitted use and the existing Single-Family Attached Dwellings are an existing non-conforming condition. The Applicant is seeking variance approvals for the above-referenced property. The Applicant is proposing to remove the existing retaining waall(3 Foot in height) along the property line that is severely out of plumb, cracked and deterioating and replace it with a masonry wall (4 Foot-7 Inches in height) and reinstall a 6 Foot Vinyl Fence.
The Applicant seeks approval of the following required variances:
VARIANCES
1. Per §135-101.1.A. Retaining walls shall not exceed three feet in height at any point. Terraced retaining walls involving more than one section of wall above or below each other shall be construed as one wall unless the base of the upper wall is separated from the face of the lower wall by at least 4 Feet measured horizontally. A variance is required to allow a retaining wall 4.67 Feetin height and a 6 Foot fence for a total height of 10.67 Feet.
2. Per §135-101.1.B. Retaining walls shall be set back from any property line a distance of at least One Foot for each Foot of height of the retaining wall. A variance is required to allow a retaining wall on the property line where a 4.67-Foot setback is required.
3. Per §135-101.1.D. On the event that a fence, safety barrier or other restraining device is provided at the top of the wall, the total height of the wall with the fence, safety barrier and/or restraining device shall not exceed the height limitations set forth for fences f in §135-96 of this code. It is noted that the existing condition has a a6-Foot fence at the top of the retaining wall. A variance is required to allow a 4.67 Foot retaining walls involving more and a 6-Foot fence to exceed the maximum height of 6 Feet.
4. Per §135-33D(4)(b), the maximum impervious coverage permitted in the zoning district is 50%. The existing impervious coverage is 72.6% (our office scaled this from the survey plan provided). Testimony should be provided regarding whether the width and/or length of the proposed retaining wall is to be greaTed than what is existing, in addition, the further testimony should be provided whether any change to the existing driveway is as a result of the proposed retaining wall. Should impervious coverage change for any reason, a variance will be required.
5. The following are existing non-conforming conditions which are not impacted by this application:
a. Per §135-33D(1)(a), the minimum required lot size is 4,000SF where 3,550SF exists.
b. Per §135-33D(1)(b), the minimum lot width is 40FT where 33.57FT exists.
c. Per §135-33D(1)(c), the minimum required lot frontage is 49FT where 33.57FT exists.
d. Per §135-33D(2)(a), the minimum required front yard is 40FT (if a front yard analysis cannot be performed). The existing front yard along Lakeview Avenue is 30.77FT and 0.37FT along Centre Street.
e. Per §135-33D(4)(a), the minimum required building coverage is 30% where 36.3% exists.
The Applicant also requests any additional variances, submission waivers, additional exceptions, design waivrs, de minimis exceptions, interpretations, modifications of conditions of prior approvals, continuation of any pre-existing non-conforminjg conditions, conditional use approval, other approvals reflected on the plans. (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the Application by the Board and its professional staff and
permits requested or required by the Board at the Public Meeting.
This Application shall be considered by the Board at a Public Hearing on July 21, 2026 at 7:00PM, in person, in the Borough Hall Auditorium, 242 Kings Highway East, Haddonfield, New Jersey 08033, at which time you may appear either in person or through an Attorney and present any objection that you may have to the granting of this Application.
