Notice of Intent to Modify Title V Operating Permit 25-00179
In accordance with 25 Pa. Code §§127.521 and 127.541, the Department of Environmental Protection intends to modify the existing Title V Permit for the wastewater treatment plant located at 68 Port Access Road in the City of Erie, Erie County. The facility’s representative to contact concerning this application is Mr. Basil Ronziti (814) 870-1360.
The subject application is for the Significant Modification (MOD) to remove the compliance schedule requirement from the Title V Permit. The MOD requested removal of the compliance schedule (identified as Conditions #016-#020 of Section C.IX of the Title V Permit). The items in the compliance schedule were proposed by the facility during the review of the Title V Renewal Permit to address the non-compliance with the cadmium emission limits in 40 CFR Part 60 Subpart MMMM, and 40 CFR part 62, Subpart LLLL over the period of October 2020 through October 2024 for Incinerator #1 (Source 001). The schedule included progressive actions from cleaning, minor repairs to the scrubber, and eventual replacement of the scrubbers. The facility conducted additional cadmium testing on September 24, 2025. The information was submitted after the Title V Permit was renewed on October 1, 2025. The report was received by the DEP November 24, 2025 and showed compliance with the cadmium emission limits.
Given the compliant emissions testing for cadmium, the compliance schedule was no longer necessary to demonstrate compliance, and the facility therefore requested the removal of the conditions.
A copy of the application, the Department’s analysis and other documents used in the evaluation of the application are available for public inspection during the normal business hours at the Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335.
Any person wishing to provide the Department of Environmental Protection with additional information that they believe should be considered prior to the issuance of this permit may submit the information to the Department at the address shown above. A 30-day comment period, from the date of this publication, will exist for the submission of comments. Each written comment must contain the following information:
• Name, address and telephone number of the person submitting the comments.
• Identification of the proposed permit (specify Permit #TV 25-00179)
• Concise statements regarding the relevancy of the information in the proposed permit or objections to issuance of the permit.
A public hearing may be held, if the Department, in its discretion, decides that such a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or by the Pennsylvania Bulletin, or by telephone, where the Department determines such notification by telephone is sufficient.
