ORDINANCE NO. 5162 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, APPROVING GROUND LEASE NO. 19 WITH CHD CURTIS EAST, LLC; AND AUTHORIZING THE MAYOR TO SIGN THE GROUND LEASE AND THE CITY MANAGER TO SIGN ALL DOCUMENTS AND TAKE ALL OTHER ACTION NECESSARY OR APPROPRIATE. WHEREAS, the City of Chandler owns 4.798 acres of vacant land (the “Property”) at the Chandler Municipal Airport obtained with Federal Aviation Administration (“FAA”) funds and intended for development for aviation-related purposes; and WHEREAS, the City issued a Request for Proposals on June 5, 2025, for hangar development at the Property and received four proposals; and WHEREAS, Dark Horse Aviation’s proposal was selected for award; and WHEREAS, Dark Horse Aviation has formed and controls a separate entity known as CHD Curtis East, LLC to enter into Airport Lease No. 19 and operate the project. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, as follows: Section 1. Approves the execution of the Lease between the City of Chandler and CHD Curtis East, LLC in substantially the form attached hereto as Exhibit “A.” Section 2. Authorizes the Mayor of the City of Chandler to execute the Lease and the City Manager, or designee, to sign all documents and take all action necessary or appropriate to carry out the purposes of this Ordinance.
